Right of way (R/W) definition

Right of way (R/W) means a general term denot- ing land or interest therein, acquired for or designated for transportation purposes. More specifically, land in which the department, a county, or a municipality owns the fee simple title, has an easement devoted to or required for use as a pub- lic road and appurtenant facilities, or has established owner- ship by prescriptive right, or lands that have been dedicated for public transportation purposes.

Right of way (R/W) means the area between property lines of a street, easement, tract or other area dedicated to the movement of vehicles, pedestrians or goods; dedicated or deeded to the public for public use and under the control of a public agency; or a private right-of-way in private ownership, for use by the property owner and those having express or implied permission by the property owner, but not by others.
