  • In any circumstance where the Service Provider does not formally accept a Draw-down Contract, dispatch or delivery of the Mechanical Road Condition Survey by the Service Provider to the Framework Purchaser shall be deemed conclusive evidence of the acceptance of a purchase order and the terms and conditions of the Draw-down contract thereby constituted.

  • The Service Provider shall send an invoice to the Framework Purchaser on delivery of the relevant Mechanical Road Condition Survey in the format specified or at such other time(s) as set out in the Draw-down Contract.

  • By signing and returning or otherwise acknowledging a Draw-down Contract, the Service Provider acknowledges and agrees that it shall have entered into a legally binding contract with the Framework Purchaser to provide the Mechanical Road Condition Survey at the location specified in the relevant Draw-down Contract to the Framework Purchaser incorporating terms and conditions set out in this Framework Agreement.

  • If a Framework Purchaser selects the Service Provider to provide the Mechanical Road Condition Survey Services, the Service Provider shall enter into a Draw-down Contract with the Framework Purchaser.

Related to Road Condition Survey

  • Contracting Body Satisfaction Survey shall have the meaning set out in Clause 18.1;

  • Existing Survey means the existing ALTA survey of the Property.

  • Survey means a survey of the Property prepared by a surveyor licensed in the State and satisfactory to Lender and the company or companies issuing the Title Insurance Policy, and containing a certification of such surveyor satisfactory to Lender.

  • Independent Software Vendor or “ISV” means a Person that makes available to Participants and Authorized Traders a system or platform offering smart order routing, front-end trading applications, an aggregation platform or a combination of the foregoing but that does not provide Participants or Authorized Traders with the ability to effect transactions other than through the Trading System.

  • Title Report has the meaning set forth in Section 5.4(b).
