Second Amendment Execution Date definition

Second Amendment Execution Date means June 5, 2020.

Second Amendment Execution Date means the “Execution Date”, as defined in that certain Amendment No. 2 to Credit Agreement and Consent and Waiver, dated as of February 15, 2013, by and among the Parent, EnergySolutions, the Administrative Agent and the Lenders party thereto.

Second Amendment Execution Date means the date as of which the Second Amended Agreement has been executed by Borrower, Sands Regent and each of the Banks.

• From and after the Second Amendment Execution Date, the term “License Area” as used in the Agreement shall mean the Existing License Area plus the Second Amendment License Area.

• As of the Second Amendment Execution Date, Article 10 of the First Amendment is hereby deleted in its entirety and shall no longer be of any further force or effect.

• Landlord and Tenant have executed this Amendment as of the Second Amendment Execution Date.

• Effective as of the Second Amendment Execution Date, the License Area is hereby expanded to include the Second Amendment License Area.

• Xxxxxxxx-Xx Xxxxx Ltd, intending to be bound, have caused this Second Amendment to be executed as of the Second Amendment Execution Date.

• Effective as of the Second Amendment Execution Date, Tenant’s Pro Rata share shall be equal to 85.75%.

• If Novartis has not received the First Portion of Outstanding Milestone Payment within three (3) Business Days of the Second Amendment Execution Date then this Second Amendment shall be automatically be deemed to have been terminated and shall have no force or effect.
