Second Tier Supply Business definition

Second Tier Supply Business means the authorised business (if any) of the Licensee or any affiliate or related undertaking as a private electricity supplier.

Examples of Second Tier Supply Business in a sentence

• In the provision of use of system the Licensee shall not discriminate: (a) between any Authorised Electricity Operators or class or classes thereof; or (b) as between the Licensee (in the provision of use of system by the Licensee as part of its Distribution Business to itself for the purpose of its Supply or Second Tier Supply Business) and any Authorised Electricity Operator or class or classes thereof.

• Subject to paragraph 3, and other than information made available to all Second Tier Suppliers and/or customers, or a class of information made available to Second Tier Suppliers and/or customers on equivalent terms, the licensee shall procure that the Second Tier Supply Business does not use, or seek to obtain, directly or indirectly any commercially sensitive information from any Regulated Business.

• It requires the Director to have regard to the part of the capacity of the Interconnector already contracted to persons other than the licensee and its affiliates and “the part approved by the Director as being reserved to the licensee and affiliates and related undertakings of the licensee for the purpose of the Supply Business, Second Tier Supply Business and Wholesaling Business” (all as defined in Part II of the composite licence).

• Subject to paragraph 3, the licensee shall procure that the Second Tier Supply Business does not disclose directly or indirectly any commercially sensitive information to any Regulated Business.
