Specified Customer definition

Specified Customer means an Customer specified on Schedule 1.1(C).

Specified Customer means those certain Persons set forth on Section 1.1(kkkk) of the Company Disclosure Letter.

Specified Customer shall have the meaning ascribed to such term in a letter agreement among Agent and Borrowers dated the Agreement Date.

Examples of Specified Customer in a sentence

• Borrowers shall ensure that Agent has all information necessary to electronically access shipping information provided by any carrier or provider of Specified Customer Inventory, including providing Agent with updates to such information as may from time to time be necessary.

• Recoveries on Specified Customer Preference Claims shall first be used to pay the fees and expenses of pursuing such claims and thereafter shall be exclusively distributed to the holders of allowed Securities Customer Claims.

• This subsection does not apply to recoveries on Specified Customer Preference Claims.

• Recoveries on Specified Customer Preference Claims shall be treated as distributions of customer property for purposes of recalculating Implied Deficiency Claims and making further True-up Distributions.

More Definitions of Specified Customer

Specified Customer has the meaning set forth in Schedule 1.01(n).

Specified Customer means a company that is a customer of the Company accounting for at least ten per cent (10%) of the revenues of the Company in the last twelve (12) months and whose name is set out on Schedule 4, as the same may be amended by the Company upon notice to Investor pursuant to Section 12.10 no more than once per year to substitute any other customer that accounted for at least ten per cent (10%) of the Company’s revenues in the last twelve (12) months; provided, however, that such Schedule shall include no more than five (5) companies at any one time;

Specified Customer means a customer to which sales of products manufactured by all Company Subsidiaries represented 20% or more of all Company Subsidiaries’ aggregate annual revenue for the year ended December 31, 2018 and the year ended December 31, 2019.

Specified Customer means each of Cargill Salt Ltd., Canadian Salt Company Ltd. and Cliff Sales Company.

Specified Customer means the Customer specified by separate letter agreement.

Specified Customer means the Person set forth on Annex 1.01(f).

Specified Customer means those customers listed on Schedule 8.7A attached hereto and (ii) “Customer Project” means those projects listed on Schedule 8.7B attached hereto.
