State experience definition

State experience means the most recent published claim rates or loss ratios based on the experience of all insurers in this state for a plan of insurance and class of business. However, if this state enters into agreements with other similar states, the use of the appropriate multi-state experience will be substituted for the experience in this state. If published experience is not available for this state or multi-state region, the claim rates assumed in this state's prima facie rates and the minimum loss ratio required by Section 5 of this Regulation will be used.
