If the Distributor intends to make a change to its Pricing Structure that will materially affect the Trader or 1 or more Customers, the Distributor must first consult with the Trader about the proposed change.
Once a change to a Pricing Structure has been finalised in accordance with clause 7.4, or a Price change is notified in accordance with clause 7.5, the Trader may raise a Dispute under clause 23 in respect of the Pricing Structure or the Price change only if the Trader considers that the Distributor has not complied with clause 7.4 or 7.5 (as the case may be).
Loss or damage caused by or consequent upon subsidence, heave or landslip unless such loss or damage is as a result of a Defect in the design, workmanship, materials or components of the Structure of a Housing Unit.
If the Owner desires to cancel this Agreement due to the circumstances outlined in this Section 8, either party may request a hearing before the City Council to determine (a) the extent of diminution of value, (b) the extent of the damage or destruction to the floor area of the Structure, and/or (c) extent of damage or destruction to the Character Defining Features of the Structure.
In either case caused by a defect in the design, workmanship, materials or components of: • the Structure; or • the waterproofing elements of the Waterproof Envelope which is first discovered during the Structural Insurance Period.
