Teacher or Principal Data definition

Teacher or Principal Data means personally identifiable information, as defined in Section 2-d, relating to the annual professional performance reviews of classroom teachers or principals that Vendor may receive from the District pursuant to the Master Agreement.

Teacher or Principal Data means personally identifiable information from the records of an educational agency relating to the annual professional performance reviews of classroom teachers or principals that is confidential and not subject to release under the provisions of Education Law Sections 3012-c and 3012-d.

• Student Data and/or Teacher or Principal Data which the Contractor comes into possession as part of its Agreement with the District shall be used for the following exclusive purpose(s): Pursuant to and as fully described in the Service Agreement, Provider has agreed to provide the digital educational services set forth below and any other products and services that Provider may provide now or in the future (the “Services”).

• The successful Bidder shall provide its services in a manner which protects Student Data (as defined by 8 NYCRR § 121.1(q)) and Teacher or Principal Data (as defined by 8 NYCRR § 121.1(r)) (hereinafter “Confidential Data”) in accordance with the requirements articulated under Federal, State and local laws and regulations, including but not limited to the foregoing: (a) The successful Bidder will adopt technologies, safeguards and practices that align with the NIST Cybersecurity Framework.

• The County shall provide the contracted services in a manner which protects Student Data (as defined by 8 NYCRR 121.1(q)) and Teacher or Principal Data (as defined by 8 NYCRR 121.1(r)) (hereinafter “Confidential Data”) in accordance with the requirements articulated under Federal, New York State and local laws and regulations, including but not limited to Education Law Section 2-d and the associated regulations (8 NYCRR Part 121).

• Please see Contractor’s Data Privacy and Security Plan, incorporated herein as Schedule 3, for a description of how Contractor will help ensure that the subcontractors, or other authorized persons or entities to which Contractor will disclose Student Data (and, to the extent that Contractor maintains any Teacher or Principal Data, any Teacher or Principal Data).

• As used herein, “Protected Data” means Student Data (as defined in NY 2- d) and/or Teacher or Principal Data (as defined in NY 2-d).

For purposes of this Schedule, “student data” includes information made accessible to Contractor by BOCES, BOCES officers, BOCES employees, BOCES agents, BOCES students, and/or the officers, employees, agents, and/or students of educational agencies that contract with BOCES in order to access Contractor’s services.

Teacher or Principal Data or "APPR" means personally identifiable information from the records of an educational agency relating to the annual professional performance reviews of classroom teachers or principals that is confidential and not subject to release under the provisions of N.Y. Education Law §§ 3012-c and 3012-d. For purposes of this Schedule, “student data” includes information made accessible to Contractor by BOCES, BOCES officers, BOCES employees, BOCES agents, BOCES students, and/or the officers, employees, agents, and/or students of educational agencies that contract with BOCES in order to access Contractor’s services.

Teacher or Principal Data means personally identifiable information, as defined in Section 2-d, relating to the annual professional performance reviews of classroom teachers or principals that Banzai may receive from the District pursuant to the Master Agreement.
