The Vendor and the Purchaser agree that all disputes, if any, respecting any aspect of construction of the Purchased Home or the common elements of the Condominium, including disputes alleging negligence, breach of contract, breach of duty or breach of warranty, shall be limited solely to the dispute resolution mechanisms prescribed by The ONHWP Act, which resolution thereunder shall be binding and conclusive on all parties.
At the time of the PDI, the Purchaser, the Purchaser’s Designate or the Purchaser’s Solicitors and the Vendor shall complete a single Certificate of Completion and Possession (the “CCP”), a Pre-Delivery Inspection Form (the “PDI Form”) and a Confirmation of Receipt in the forms prescribed from time to time by, and required to be completed pursuant to The ONHWP Act, listing all outstanding, incomplete work or defective items in the Purchased Home.
Furthermore, the Vendor shall not be liable for any secondary or consequential damages whatsoever which may result from any defect in materials, design or workmanship related to the Condominium and/or the Purchased Home except as required under The ONHWP Act.
