Tobacco User definition

Tobacco User means a person who is permitted under state and federal law to legally use tobacco, with tobacco use (other than religious or ceremonial use of tobacco), occurring on average four or more times per week that last occurred within the past six months (or such other meaning required or permitted by applicable law). Tobacco User means a Participant who has used tobacco or tobacco products (including, but not limited to cigarettes, snuff, chewing tobacco, cigars, pipe tobacco and other similar products in any quantity) during the last twelve (12) months.

  • A Tobacco User may be subject to a Premium increase of up to 1.5 times the rate applicable to those who are not Tobacco Users, to the extent permitted by applicable law, provided that HMO will provide an opportunity to offset such Premium variation through participation in a wellness program to prevent or reduce Tobacco Use, if required by applicable law.

  • Effective January 1, 2009 and thereafter employees and/or covered spouses who use Tobacco are required to pay a Tobacco User Premium equal to 10% of the medical plan’s monthly premium cost of single coverage.

  • Employees who smoke shall be charged a Tobacco User Premium of ten percent (10%) of the total premium cost of single coverage per employee in addition to his/her monthly employee contribution.
