Tobacco User definition

Tobacco User means a person who is permitted under state and federal law to legally use tobacco, with tobacco use (other than religious or ceremonial use of tobacco), occurring on average four or more times per week that last occurred within the past six months (or such other meaning required or permitted by applicable law).   • A Tobacco User may be subject to a Premium increase of up to 1.5 times the rate applicable to those who are not Tobacco Users, to the extent permitted by applicable law, provided that HMO will provide an opportunity to offset such Premium variation through participation in a wellness program to prevent or reduce Tobacco Use, if required by applicable law.
