Unauthorized Overrun Service definition

Unauthorized Overrun Service means service provided when the quantities of Gas received from or delivered to (or on behalf of) Shipper at a Point are, (i) if such quantities are equal to or below Shipper’s Point MDQ for such Point under Shipper’s FTS Agreement(s), in excess of the confirmed and scheduled quantities at such Point by more than 5%, or (ii) if such quantities are in excess of Shipper’s Point MDQ for such Point under Shipper’s FTS Agreement(s), in excess of the confirmed and scheduled quantities at such Point.

Examples of Unauthorized Overrun Service in a sentence

  • Shipper shall pay TIGER the charges for Unauthorized Overrun Service set out in Section 9.2 of the General Terms and Conditions of this Tariff.

  • Unauthorized Overrun Service is subject to the charges set out in Section 9.2 of these General Terms and Conditions.

  • In light of Shipper's obligations to remain in balance under Section 10 of these General Terms and Conditions, to the extent that Receipt Point or Delivery Point imbalances are not accommodated under an OBA, an Unauthorized Overrun Service rate set out herein shall apply to all quantities tendered by or on behalf of Shipper or taken by or on behalf of Shipper at any Points which constitute Unauthorized Overrun Service.

  • Quantities at Delivery Points which can be accommodated under an OBA shall not be considered Unauthorized Overrun Service.

  • Any such waiver shall be granted on a non- discriminatory basis to all Shippers that incurred an Unauthorized Overrun Service Charge in that instance.

  • Any Unauthorized Overrun Service Charge billed and collected by Transporter shall be refunded, net of cost, pursuant to Section 37 of the General Terms and Conditions of this Tariff.

  • All Overrun Service under this Rate Schedule during periods in which prorating of capacity is in effect shall be deemed to be Unauthorized Overrun Service.

  • Any such waiver shall be granted on a non-discriminatory basis to all Shippers that incurred an Unauthorized Overrun Service Charge in that instance.

  • In each instance when an Unauthorized Overrun Service Charge is incurred, Transporter shall have the right to review the circumstances surrounding the Unauthorized Overrun Service Charge incurrence and, in its judgment, may waive all or a portion of the Unauthorized Overrun Service Charges.

  • For any Overrun Service hereunder which is not authorized ("Unauthorized Overrun Service"), Shipper shall pay Transporter, in addition to the Authorized Overrun Service Charge, an Unauthorized Overrun Service Charge.

Related to Unauthorized Overrun Service

  • Unauthorized Gas means (a) the quantity of gas taken by Customer exceeding the amount which is permitted during a Period of Interruption or (b) the difference (whether positive or negative) between the quantity of gas taken by Customer and the volumes provided for under an Operational Flow Order.

  • Unauthorized Access means the entrance of a person into a restricted area without permission of the operator or the operator’s designated representative.

  • Unauthorized Use means either of the following:

  • Unauthorized person means any person who accesses government data without a work assignment that reasonably requires access, or regardless of the person's work assignment, for a purpose not described in the procedures required by section 13.05, subdivision 5.

  • Unauthorized alien means an alien as defined in Section 1324a(h)(3) of Title 8 of the United States Code.

  • Unauthorized signature means one made without actual, implied, or apparent authority and includes a forgery.

  • Access Service Request (ASR) is an industry standard form used by the Parties to add, establish, change or disconnect trunks for the purposes of Interconnection.

  • Medication error means any preventable event that may cause or lead to inappropriate medication use or patient harm, while the medication is in the control of the health care professional, patient, or consumer. Such events may be related to professional practice, health care products, procedures, and systems including, but not limited to: prescribing; order communication; product labeling, packaging and nomenclature; compounding; dispensing; distribution; administration; education; monitoring; and use.

  • Unauthorized Third Party means any person or entity that, at the time of the Computer Fraud, is not an Authorized User.

  • Unauthorized signature means a signature made without actual, implied, or apparent authority. The term includes a forgery.

  • Unauthorized Removal means the Contractor’s removal of Key Personnel without the prior written consent of the State.

  • NAV Error means an error in the computation of the net asset value for a Fund or class as more fully described in the NAV Error Policy.

  • Service Request means a request for service such as adds, moves, changes and technical assistance;

  • Collective Work means a work, such as a periodical issue, anthology or encyclopedia, in which the Work in its entirety in unmodified form, along with a number of other contributions, constituting separate and independent works in themselves, are assembled into a collective whole. A work that constitutes a Collective Work will not be considered a Derivative Work (as defined below) for the purposes of this License.

  • Contractor attributional/proprietary information means information that identifies the contractor(s), whether directly or indirectly, by the grouping of information that can be traced back to the contractor(s) (e.g., program description, facility locations), personally identifiable information, as well as trade secrets, commercial or financial information, or other commercially sensitive information that is not customarily shared outside of the company.

  • Cost of idle facilities or idle capacity means costs such as maintenance, repair, housing, rent, and other related costs, e.g., insurance, interest, property taxes and depreciation or use allowances.

  • Construction Service Agreement means either an Interconnection Construction Service Agreement or an Upgrade Construction Service Agreement.

  • Project Data means all proprietary data of the Project generated out of the Project operations and transactions, documents and related information including but not restricted to user data which the Bidder obtains, possesses or processes in the context of providing the Services to the users pursuant to this RFP including the SLA;

  • Certified Remanufacture System or Verified Engine Upgrade means engine upgrades certified or verified by EPA or CARB to achieve a reduction in emissions.
