A University Program or Activity includes locations, events or circumstances over which the University exercises substantial control over both the Respondent and the context in which the Title IX Prohibited Conduct occurs, and includes any building (including off-campus buildings) owned or controlled by a student organization that is officially recognized by the University.
To fall within the jurisdiction of Title IX, such conduct must have taken place in a University Program or Activity and against a person in the United States at the time the conduct occurred.
An off-campus event (in the United States) such as an academic or professional conference may constitute a University Program or Activity if, for example, it is a University-sponsored event or the University otherwise maintains substantial control over the event and Title IX Prohibited Conduct occurs within the context of such an event.
Except as otherwise specified in the definitions below, adjudicatory jurisdiction under this policy extends to Prohibited Conduct that is alleged to have occurred within a University Program or Activity, or that has a material adverse effect on an individual’s participation in or attempted participation in a University Program or Activity.
This policy applies to all employees of the University and any persons participating, or attempting to participate, in any University Program or Activity.

If the Respondent is no longer a Student, Employee, or a person who is participating or attempting to participate in any University Program or Activity at the time of the report, and/or if the reported conduct does not fall within the definition of Prohibited Conduct, the University’s ability to take action against the Respondent under the Policy may be limited.
A hostile environment exists when the unwelcome conduct of a sexual nature is sufficiently severe, persistent, or pervasive that it unreasonably interferes with an individual’s participation in a University Program or Activity or creates an intimidating, hostile, offensive, or abusive environment for that individual’s participation in a University Program or Activity.
