Updated Surveys definition

Updated Surveys has the meaning ascribed to such term in Section 6.1.

Examples of Updated Surveys in a sentence

  • Any such modification, update or recertification of the Updated Surveys may be obtained by Purchaser at its sole cost and expense.

  • If Sellers have not received such written notice from Purchaser by the Title Notice Date, Purchaser shall be deemed to have unconditionally approved the specific exceptions to title expressly provided in the PTRs and all matters revealed in the Updated Surveys, subject to Sellers’ obligations set forth in Section 6.2(c) below and as otherwise expressly provided in this Agreement.

  • Purchaser, at its election, or as Purchaser's lenders may require, may have updates or new surveys made at its expense ("Updated Surveys").

  • Purchaser shall use commercially reasonable efforts to obtain the commissioned Updated Surveys as soon as possible.

  • Any item contained in the Title Report or any matter shown on the Surveys or on any Updated Surveys (if any) to which Purchaser does not object prior to the Title Exam Deadline shall be deemed a Permitted Exception.

  • If Purchaser shall notify Seller of objections to title or to matters shown on the Surveys or the Updated Surveys prior to the Title Exam Deadline, Seller shall have the right, but not the obligation, to cure such objections.

  • Purchaser shall have until the date (the “Title Exam Deadline”), which is five (5) business days prior to the expiration of the Inspection Period to notify Seller, in writing, of such objections as Purchaser may have to anything contained in the Title Report, the Surveys or any Updated Surveys, if any.


More Definitions of Updated Surveys

Updated Surveys means, with respect to each parcel of Owned Real Property, a current ALTA survey prepared by duly licensed land surveyors acceptable to Buyer.

Updated Surveys means, with respect to each parcel of Owned Real Property, a current ALTA survey prepared by duly licensed land surveyors that (i) shall show the location on such Owned Real Property of all improvements, buildings set-back lines, fences, evidence of abandoned fences, ponds, creeks, streams, rivers, officially designated flood plains and flood prone areas, canals, watercourses, easements, roads, rights-of-way, encroachments, public roads providing access to the Owned Real Property, the boundary of Owned Real Property, and other such matters affecting the Owned Real Property whether physically apparent from a physical inspection, of record in public offices, or otherwise, all in accordance with the ALTA Standards, (iii) shall contain a legal description of the boundaries of the land by metes and bounds which shall include a reference to the recorded plat, if any, (iv) shall contain such “Table A” items from the ALTA Standards as reasonably requested by Buyer and agreed to by the applicable surveyor, (v) shall be certified to Buyer and the reputable title company in the form prescribed by the ALTA Standards, and (vi) reflects all visually plottable Encumbrances described on the Updated Title Commitment with respect to such property in accordance with the ALTA Standards.

Related to Updated Surveys

  • Surveys has the meaning set forth in Section 4(o) above.

  • Title Policy shall have the meaning set forth in Section 4.2.

  • Environmental Report The environmental audit report or reports with respect to each Mortgaged Property delivered to the related Mortgage Loan Seller in connection with the origination or acquisition of the related Mortgage Loan.

  • Phase I Environmental Report means a report by an Independent Person who regularly conducts environmental site assessments in accordance with then current standards imposed by institutional commercial mortgage lenders and who has a reasonable amount of experience conducting such assessments.

  • Phase I assessment as described in, and meeting the criteria of, (i) Chapter 5 of the FNMA Multifamily Guide or any successor provisions covering the same subject matter in the case of a Specially Serviced Mortgage Loan as to which the related Mortgaged Property is multifamily property or (ii) the American Society for Testing and Materials in the case of Specially Serviced Mortgage Loan as to which the related Mortgaged Property is not multifamily property.

  • Architect/Engineer means the person designated by the Commissioner to provide the Contract drawings and Detailed Specifications for the Work you are to perform.

  • Updated Appraisal means an Appraisal of the Mortgaged Property or related REO Property, as the case may be, conducted subsequent to any Appraisal performed on or prior to the date of this Agreement by an Appraiser, selected by the applicable Servicer, in accordance with MAI standards, the costs of which shall be paid as a Property Advance by the Lead Securitization Note Holder or applicable Servicer.

  • Title Documents shall have the meaning set forth in Section 4.1.

  • Record of survey map means a map of a survey of land prepared in accordance with Section 10-9a-603, 17-23-17, 17-27a-603, or 57-8-13.

Quantity Surveyor Assessment means an assessment by an independent Quantity Surveyor of the Construction Cost to the reasonable satisfaction of the Council. Regulation means the Environmental Planning and Assessment Regulation, 2000 (as amended).

  • Preliminary Title Report A report issued by a title insurance company in anticipation of issuing a Title Insurance policy which evidences existing liens and gives a preliminary opinion as to the absence of any encumbrance on title to a Mortgaged Property, except liens to be removed on or before purchase or refinance, as the case may be, by the Borrower and Permitted Encumbrances.

  • Project Architect means the professional architect or engineer employed by the Owner as architect or engineer of record for the Project and its consultants.

  • Environmental Audit means, with respect to each Property, a Phase One environmental site assessment (the scope and performance of which meets or exceeds the then most current ASTM Standard Practice E1527 for Environmental Site Assessments: Phase One Environmental Site Assessment Process) of such Property.

  • Independent Engineering Report means a report, in form and substance satisfactory to the Administrative Agent and each of the Lenders, prepared by an Independent Engineer, addressed to the Administrative Agent and the Lenders with respect to the Oil and Gas Properties owned by the Borrower or its Subsidiaries (or to be acquired by the Borrower or any of its Subsidiaries, as applicable) which are or are to be included in the Borrowing Base, which report shall (a) specify the location, quantity, and type of the estimated Proven Reserves attributable to such Oil and Gas Properties, (b) contain a projection of the rate of production of such Oil and Gas Properties, (c) contain an estimate of the net operating revenues to be derived from the production and sale of Hydrocarbons from such Proven Reserves based on product price and cost escalation assumptions specified by the Administrative Agent and the Lenders, and (d) contain such other information as is customarily obtained from and provided in such reports or is otherwise reasonably requested by the Administrative Agent or any Lender.

  • Professional land surveyor means a professional land surveyor licensed under ch. 443.

  • Survey Report means a report of the results of a Survey, containing the information set out in clause 12.4 and Schedule 6.

  • Title Commitments has the meaning set forth in Section 5.9.

  • Base Case Projections means the initial forecast for the Project prepared as of the Effective Date using the Base Case Financial Model.
