Vessel A definition

Vessel A has the meaning given to it in the recitals; and

Vessel A means the capesize bulk carrier of about 170,000 dwt which is being or to be constructed by the Builder with Builder’s Hull No. S1068 for, and purchased by, Chilali under the Vessel A Shipbuilding Contract;

Vessel A means the 159,000 dwt suezmax tanker “Windsor Xxxxxxx” built in 2007 and registered in the name of the Vessel A Owner in the Norwegian international ship registry.

• The Vessel A Owning Subsidiary and the Vessel A are free of all Encumbrances other than the Encumbrances arising under the Charter A.

• The Vessel A Owning Subsidiary (and the Vessel A owned by it) has no liabilities or obligations of any nature, whether absolute, accrued, contingent or otherwise, and whether due or to become due (including, without limitation, any liability for Taxes and interest, penalties and other charges payable with respect to any such liability or obligation).

• CMTC wishes to transfer to CPLP all rights, title and interest in the Vessel A, and retain all assets, other than the Vessel A, the Contracts A (as defined below) and any necessary permits, and all liabilities of the Vessel A Owning Subsidiary.

Vessel A means m.v. “ARCTIC SPIRIT” and everything now or in the future belonging to it on board and ashore, currently registered under the flag of the Bahamas in the ownership of Arctic Spirit L.L.C..

Vessel A means the capesize bulk carrier of about 180,000 dwt which is being or to be constructed by the Builder with Builder’s Hull No. S1065 for, and purchased by, Kohylia under the Vessel A Shipbuilding Contract;

Vessel A means m.v. "HISPANIA SPIRIT" and everything now or in the future belonging to her on board and ashore.

Vessel A means the 2006-built Panamax bulk carrier of about 75,756 dwt owned by the Vessel A Seller and which is to be purchased by Sagittarius and registered in its ownership on the Panamanian flag with the name “NAVIOS SAGITTARIUS”;

Vessel A means the double-hull single screw diesel engine driven xxxxxx of diesel oil gasoline and other clean and dirty oil products with roro facility of approximately 2,400 dwt having hull no. N2230007 to be constructed by the Builder pursuant to the Shipbuilding Contract A, to be acquired by the Borrower A and to be registered on the relevant Delivery Date in its ownership under a flag acceptable to the Creditor Parties under a name approved by the relevant flag authorities;
