Yield Restricted definition

Yield Restricted means required to be invested at a yield that is not materially higher than the yield on the Notes under section 148 (a) of the Internal Revenue Code or regulations issued thereunder.
Yield Restricted or "Yield Restriction" shall mean required to be invested at a Yield that is not materially higher than the Yield with respect to the Obligation of the applicable issue under Code §148 and Treasury Regulations § 1.148 -2.

Examples of Yield Restricted in a sentence

  • Proceeds of the Agreement and investment earnings thereon that must be Yield Restricted pursuant to this Section 4.3 will either (i) be invested at a yield not materially higher (⅛%) than the yield on the Agreement or (ii) be invested in Tax-Exempt Obligations that are not specified private activity bonds as described in Section 57(a)(5)(C) of the Code.

  • If, at some future date, the Sinking Fund does not qualify as a Bona Fide Debt Service Fund, they must be invested in Yield Restricted Investments.

  • Each Person in the High Yield Restricted Group shall not, and the Company shall not directly or indirectly permit any Person in the High Yield Restricted Group to, take any action that is prohibited by the negative covenants set forth in the High Yield Notes Indenture (including, for the avoidance of doubt, the covenants set forth in Article 4 of the High Yield Notes Indenture as of the Issue Date).
