Cancellation of Capacity Agreements. In the event of an essential breach of a Capacity Agreement, a Party shall have the right to cancel the Capacity Agreement. As the validity of this Framework Agreement is a condition for Capacity Agreements, the cancellation of this Framework Agreement shall be regarded as an essential breach of a Capacity Agreement based on which the Transmission System Operator with System Responsibility may cancel a Capacity Agreement. In cases where the Transmission System Operator with System Responsibility has had to restrict the use of firm Capacity products obtained by a Shipper due to a reason attributable to the Transmission System Operator with System Responsibility, the procedure set forth in the Gas Transmission Rules of the Transmission System Operator with System Responsibility shall apply.
