Shipper’s rights and obligations. The Shipper receives the right to use the transmission services provided by the Transmission System Operator with System Responsibility for the duration of the Capacity Periods determined by Capacity Agreements, to make Capacity Transfers relating to a concluded Capacity Agreement to another Shipper, to submit Nominations and Renominations and to perform other Shipper duties. The Shipper undertakes to comply with the Capacity-related terms and conditions provided in the Terms and Conditions of Transmission Services approved by the Energy Authority and the Gas Transmission Rules of the Transmission System Operator with System Responsibility and pay the Transmission System Operator with System Responsibility the appropriate charges related to transmission services as provided in the up-to-date Price List of the Transmission System Operator with System Responsibility. The Shipper shall meet the creditworthiness requirements set by the Transmission System Operator with System Responsibility in order to be able to book Capacity and make Capacity Transfers. The Transmission System Operator with System Responsibility undertakes to transmit natural gas owned by the Shipper in accordance with the Capacity Agreements concluded, any accepted Capacity Transfers and confirmed Nominations during the Capacity Periods determined by the Capacity Agreements and Capacity Transfers as provided in the Gas Transmission Rules of the Transmission System Operator with System Responsibility and the Terms and Conditions of Transmission Services approved by the Energy Authority. #16409964v14 The procedures for booking Capacity, Capacity products, conclusion of Capacity Agreements and Capacity Transfers as well as terms and conditions of congestion management are provided in the Terms and Conditions of Transmission Services approved by the Energy Authority and the Gas Transmission Rules of the Transmission System Operator with System Responsibility. If the Shipper wishes in an exceptional situation to use the Manual Capacity Booking Procedure or the Manual Capacity Transfer Procedure, the Shipper shall notify the Transmission System Operator with System Responsibility of this in writing (e.g. by email).
