General Conditions for sale and or rent of canoes

For groups (from 4 persons), we require a deposit : 50 % of the booking total amount ; and for individuals, the full payment of the booking (according to our following conditions).

Article 1 : Several booking’s methods are proposed, this involve to fill in our booking contract in 2 original copies, printable directly from our website xxx.xxxxxxxx-xxxxx.xxx. The “bourrellerie” du Val d’Omignon can also post you two copies of the booking contract.

- on line, via our site : payment by credit card and the canoe booking contract fully filled in send by email

- postal mail, email or phone : payment by cheque + 2 original copies of the booking contract

- reception and booking desk : payment by cash, cheque or credit card

- otherwise on the activity’s place: by cheque or cash, (according to the availabilities)

Article 2 : Customers are informed that during nature sorties pictures, video… can be taken. So their image could appear and be used.

Article 3 : The “bourrellerie” du Val d’Omignon reserves the right to change the timetable and program (for instance : weather conditions,…). This situation is not eligible for a refund, even partial. In case of cancellation for similar reasons and all other justify reasons (storm alert for instance),

1) the organizer will propose another date, with the same conditions.

2) tickets might be reimbursed. Transport, hotel and delivery costs remaining at the customer’s charge.

Article 4 : Activities prices are indicated in euro with vat, and booking fees also included.

Article 5 : Tickets can’t be taken back or exchange (except in case of date or time mistake written on the ticket), neither refund in case of loss or theft. No duplicate will be delivered. Their resale is forbidden. The ticket must be presented to the Nature Guide during the visit (welcome).

Article 6 : Booking by correspondence or phone => deferred settlement

Availability : Your order validation is only done once the payment is received (canoe booking contract in 2 original copies and payment) since it does not contain mistake (unsigned cheque, incorrect amount, incorrect date, etc..).

Payment : All orders made by correspondence needs to be paid by cheque or “mandat”. It must be made payable to « VAL D’OMIGNON » N°0 xxx xxxxxxxxxx, X-00000 XXXXXXX/Xxxxxx. By ordering, you declare to have read and accept the present general sale conditions.

Obtaining tickets : at reception of your payment, according to deadlines, 2 methods :

1/- we send you the tickets as well as your contract copy approved, by postal mail : shipment done by standard rate.

The « val d’Omignon »use external suppliers for mail sending and shall in no event be responsible in case of delay or non-delivery of your ticket, neither in case of delay in when sending payment by cheque.

- in the case the delay between your booking and the activity booked is too short to enable the payment reception, you can directly pay to

1) our welcome booking desk at « Val d’Omignon » ; Accueil et Réservation N°0 xxx xxxxxxxxxx X- 00000 TREFCON, Open 7 days / 7 from 8h00 to 21h00.

2) the Tourism Office « Haute Somme » 00, Xxxxx Xxxxx Xxxxxxx, X-00000 Péronne Phone: 00.00.00.00.00 Fax : 00.00.00.00.00. Open April to June, and September: from Monday to Saturday 10:00- 12:00 and from 14:00-18:30; July and August : from Monday to Saturday 9:00-12:00 and 14:00-18:30, Sunday 10:00-12:00 and 14:00-17:00 – October to March : Monday to Thursday 10:00-12:30 and 13:30- 17:00, Friday 10:00-12:30 and 13:30-18:00, Saturday 10:00-12:00 and 14:00-17:00.

In that case, Tourism Office conditions are applicable.

Important : the debit of your cheque is independent of your actual tickets’ pick-up. In any event, tickets are paid even if you forget to collect it before the service. No complaints can be done for all order of tickets that have not been picked up in time and so no refund can be claimed.

Article 7: on line booking – immediate payment by credit card : real time booking

Availability: the order is definitive as bank payment is done. The “Val d’Omignon » cannot be taken as responsible of mistakes done by the buyer during his/her order (address data, e-mail, error on credit card number...).

Payment: credit card payment is final and definitive as soon as payment is accepted by your bank. Credit card payment system is equipped with a safety protocol which enables you to do transactions safely.

Order confirmation: an e-mail of purchase confirmation is sent to you for the tickets bought regarding the desired visits ; it serves as proof of purchase. We invite you to consult your mail, save and print your mail of purchase confirmation.

Tickets delivery, 2 ways:

- by postal mail (please let us know)

- electronic mail (e-mail) with the message of purchase confirmation. You must, in that case, please sned an email of confirmation . You will have to print your tickets and show it to the Nature Guide the day of your appointment.

Article 8 :

- Update or cancellation from the supplier : in case a service/device is modified or cancelled by the Val d’Omignon because of a provider or a partner, the customer is informed and must cancel his/her booking and ask for reimbursement or accept the proposed modification.

- complete cancellation by the customer : all total cancellation of an order must be notify to the Val d’Omignon by phone, then by letter. The Val d’Omignon will keep the registration fees according to the following table. % of the order kept by the Val d’Omignon : j – 30 to j - 7 = 50 % et j – 7 to j and for non arrival = 100 %

Article 9 :

Complaint: in the event of complaint about your stay must be sent to the Val d’Omignon by registered letter with acknowledgement of receipt at least 15 days after the event.

Article 10 :

CNIL : In accordance with the French Data Protection and Freedom of Information Law (Loi Informatique et Liberté) of January 6th, 1978, you have a right of access, correction and opposition of the information related to you by writing us, with your full name and address: LE XXX D’OMIGNON Xx0 xxx xxxxxxxxxx 00000 XXXXXXX

Article 11 :

Applicable Law: The present sales conditions are subject to the French Law. Any disputes relating to their interpretation, execution, shall be submitted to the French Court.

General safety conditions (Canoes booking)

I certify to swim a minimum distance of 25 meters and immerge myself, including the persons/the group I have the responsibilities of.

I declare to be aware of the following requirements to wear :

- protective goggles (sunlight reflection, woodlands areas, etc,..).

- shoes and to keep them on.

- proper clothes according to the weather

- buoyancy aid (CE norm) suited to my morphology (respecting weight guidance on the life jacket )

-buoyancy and keep it on adjusted/closed from the beginning to the end and as soon as I am or remain close to the water

And

-respect Fauna and Flora (wildlife)

-not to touch, feed or approach wildlife such as swans,..

-respect people met on the river (like: fishermen, hunters,...)

-use the material respectfully (canoës, buoyancy, paddles, )

-not to get in forbidden area, dangerous or even reserved

-not to enter over the limits of navigation and respect markup

- not to access to the banks, the bed of the river, private areas in general (except in case of emergency)

- have the physical and/or mental abilities required to practice canoe (not to have medical conditions; or excessive alcohol and thus unable to canoe …)

- have ready and wear dry clean clothes to be able to use the transportation the provider will make available

-not to take on board a pet (i.e.: dog, )

- not to trouble the quiet places by swimming, water games, or shouting, etc…

- supervise, accompany adults or children I have the responsibilities, respect and make respect this code of conduct. Otherwise, my responsibilities could be challenged

- take note of emergency phone numbers registered on the water proof barrels

NB: appointment is fixed by mutual agreement between the customer and the povider. A delay of 15mn is tolerated. Over that delay, the provider can’t be held responsible and no compensation will be made.
