Liability of the Consulting Agency. The Consulting Agency’s liability under this Contract shall be as provided by the Applicable Law. Under no circumstances will Consulting Agency’s and SIDBI aggregate liability to other Party for any and all claims, including third party claims, or losses arising from or in connection with or relating to the Contract, whether in contract (including under an indemnity), tort (including negligence), strict liability, statue or otherwise, exceed an amount equal to the fees paid by SIDBI to Consulting Agency for the Service or Deliverable that gave rise to the claim. 8.3.5.
