1. ई-वनवर्दा की प्रकिया / Process of E-Tender: A) पिंजीकरण: इस प्रकिया में MSTC ई-प्रोक्योरमेंट पोटवि के साथ र्ेंडर का पिंजीकरण शावमि है जो कक वन:शु्क ह।ै पिंजीकरण के बाद ही, र्ेंडर इिेक्रॉवनक रूप से अपनी बोिी प्रस्तुत कर सकते ह।ैं तकनीकी बोिी के साथ-साथ र्ावणवययक बोिी प्रस्तुत करने के विए इिेक्रॉवनक बोिी-प्रकिया इिंटरनेट पर की जाएगी। र्ेंडर के पास हस्ताक्षर करने के विए तृतीय श्रेणी का वडवजटि प्रमाण पत्र होना चावहए। र्ेंडरों को बोिी िगाने के विए इिंटरनेट से जुड़े पीसी की स्र्यिं व्यर्स्था करनी होगी। ऐसी व्यर्स्था करने के विए MSTC वजम्मेदार नहीं ह।ै (वडवजटि हस्ताक्षर के xxxx xxxxxxxx ररकॉडव नहीं की जाएिंगी)। A) Registration: The process involves vendor’s registration with MSTC e-procurement portal which is free of cost. Only after registration, the vendor(s) can submit his/their bids electronically. Electronic Bidding for submission of Technical Bid as well as Commercial Bid will be done over the internet. The Vendor should possess Class III signing type digital certificate. Vendors are to make their own arrangement for bidding from a P.C. connected with Internet. MSTC is not responsible for making such arrangement. 	हस्ताक्षर बॉक्स में वडवजटि हस्ताक्षर प्रमाणपत्र प्रदर्शवत करने हतु “प्रोटेक्टेड मोड” को वडसेबि करने के विए वनम्नविवखत सेटटिंग को िागू करें To disable “Protected Mode” for DSC to appear in The signer box following settings may be applied.
	Tools => Internet Options =>Security => Disable protected Mode If enabled- i.e, Remove the tick from the tick box mentioning “Enable Protected Mode”. Other Settings: Tools => Internet Options => General => Click On Settings under “browsing history/ Delete Browsing History” => Temporary Internet Files => Activate “Every time I Visit the Webpage”. To enable ALL active X controls and disable ‘use pop up blocker’ under Tools→Internet Options→ custom level (Please run IE settings from the page xxx.xxxxxxxxxxxxx.xxx once)
2.	तकनीकी बोिी और र्ावणवययक बोिी ऑनिाइन रूप में xxx.xxxxxxxxxxxxx.xxx/xxxxxxxxx/xxx पर प्रस्तुत की जाएिं। वनवर्दा को वनवर्दा दस्तार्ेज़ में दी गई वनर्दवि वतवथ और समय पर इिेक्रॉवनक रूप से खोिा जायेगा। The Techno-commercial Bid and the Price Bid shall have to be submitted online at xxx.xxxxxxxxxxxxx.xxx/xxxxxxxxx/xxx. 3.	वनवर्दा में सभी प्रवर्वियािं वबना ककसी अस्पिता के ऑनिाइन तकनीकी और र्ावणवययक प्रारूपों में दजव की जानी चावहए। All entries in the tender should be entered in online Technical & Commercial Formats without any ambiguity.
4.	िेन-देन शु्क हेतु वर्शेष ध्यान देने योग्य बातें/ Special Note towards Transaction fee: र्ेंडर िेनदेन शु्क का भुगतान र्ेंडर िॉवगन के अिंतगवत “My Menu” के तहत “Transaction Fee Payment” लििंक का उपयोग करके करेंगे। र्ेंडरों को वर्वशि वनवर्दा फामव का चयन ‘इर्ेंट ड्रॉपडाउन बॉक्स’ से करना होगा। र्ेंडरों के पास भुगतान करने की सुवर्धा एनईएफटी या ऑनिाइन भुगतान के माध्यम से होगी। एनईएफटी का चयन करने पर, र्ेंडर एक फॉमव भरकर एक चािान जेनरेट करेगा। xxxxxx चािान में मुकित वर्र्रण के अनुसार और उसे बदिे वबना xxxxxx xxxx-xxxx का प्रेषण करेगा। ऑनिाइन पेमेंट का चयन करने पर र्ेंडर को अपने िे वडट / डेवबट काडव / नेट बैंककिं ग का उपयोग करके भुगतान करने का वर्क्प प्राप्त होगा। एक बार एमएसटीसी के नावमत बैंक खाते में रावश जमा हो जाने पर िेनदेन-शु्क स्र्तः अवधकृ त हो जाएगा और र्ेंडर को एक वसस्टम जेनरेटेड मेि प्राप्त होगा। xxx-xxx xxxx की र्ापसी नहीं होगी। िेन-देन शु्क का भुगतान ककए वबना र्ेंडर ऑनिाइन ई-वनवर्दा एक्सेस नहीं कर पाएगा। The vendors shall pay the transaction fee using “Transaction Fee Payment” Link under “My

	Menu” in the vendor login. The vendors have to select the particular tender from the event dropdown box. The vendor shall have the facility of making the payment either through NEFT or Online Payment. On selecting NEFT, the vendor shall generate a challan by filling up a form. The vendor shall remit the transaction fee amount as per the details printed on the challan without making change in the same. On selecting Online Payment, the vendor shall have the provision of making payment using its Credit/ Debit Card/ Net Banking. Once the payment gets credited to MSTC’s designated bank account, the transaction fee shall be auto authorized, and the vendor shall be receiving a system generated mail. िेन-देन शु्क र्ापसी योग्य नहीं है िेन-देन शु्क की र्ापसी नहीं होगी। िेन-देन शु्क का भुगतान ककए वबना र्ेंडर ऑनिाइन ई-वनवर्दा एक्सेस नहीं कर पाएगा। Transaction fee is non-refundable. A vendor will not have the access to online e-tender without making the payment towards transaction fee. नोट बोिीकतावओं को सिाह दी जाती है कक र्े गवतवर्वध समावप्त-समय के पूर्व ही िेन-दने शु्क प्रेवषत कर दें ताकक बोिी प्रस्तुत करने हतु उन्हें पयावप्त समय वमि सके । NOTE: Bidders are advised to remit the transaction fee well in advance before the closing time of the event so as to give themselves sufficient time to submit the bid.
5.	वनवर्दा प्रकिया के दौरान वनवर्दा को अिंवतम रूप कदए जाने तक अपिोड की गई वनवर्दाओं / शुविपत्र के बारे में जानकारी ईमेि द्वारा भेजी जाएगी। इसविए र्ेंडर यह सुवनवित कर िें कक एमएसटीसी पर पिंजीकरण के समय उनके द्वारा उपिब्ध कराई गई ईमेि आई.डी. र्ैध और अद्यतन हो। र्ेंडरों से यह भी अनुरोध ककया जाता है कक र्े अपने डीएससी (वडवजटि वसग्नेचर सर्टवकफके ट) की र्ैधता सुवनवित कर िें। Information about tenders /corrigendum uploaded shall be sent by email only during the process till finalization of tender. Hence the vendors are required to ensure that their corporate email I.D. provided is valid and updated at the time of registration of vendor with MSTC. Vendors are also requested to ensure validity of their DSC (Digital Signature Certificate).
6.	एनआईटी में उव्िवखत वनयत वतवथ और समय के पश्चात ई-वनवर्दा को एक्सेस नहीं ककया जा सकता ह।ै E-tender cannot be accessed after the due date and time mentioned in NIT.
7.	ई-वनवर्दा में बोिी िगाना / Bidding in e-tender: a) र्ेंडर (रों ) को ई-वनवर्दा में ऑनिाइन बोिी िगाने के विए पात्र होने के विए आर्श्यक ईएमडी, वनवर्दा शु्क और िेनदेन शु्क (यकद कोई हो) जमा करने की आर्श्यकता ह।ै वनवर्दा शु्क और िेनदेन शु्क र्ापसी

योग्य नहीं ह।ैं ईएमडी पर कोई ब्याज देय नहीं होगा। असफि र्ेंडर (रों ) की ईएमडी वनवर्दा आमिंवत्रत करने र्ािे प्रावधकारी द्वारा र्ापस कर दी जाएगी।

Vendor(s) need to submit necessary EMD, Tender fees and Transaction fees (If ANY) to be eligible to bid online in the e-tender. Tender fees and Transaction fees are nonrefundable. No interest will be paid on EMD. EMD of the unsuccessful vendor(s) will be refunded by the tender inviting authority.

b) इस प्रकिया में तकनीकी और र्ावणवययक/म्य बोिी इिेक्रॉवनक माध्यम से प्रस्तुत की जानी ह।ै

The vendor(s) who have submitted transaction fee can only submit their Technical Bid

and Commercial Bid through internet in MSTC website xxx.xxxxxxxxxxxxx.xxx → e-procurement →PSU/Govtdepts→ Login under RBI→My menu→ Auction Floor Manager→ live event →Selection of the live event.

d) र्ेंडरों को जार्ा एवलिके शन रन करने की अनुमवत देनी होगी। यह प्रकिया वबड फ्िोर खुिने के तुरिंत बाद की जानी ह।ै कफर उन्हें सामान्य शतें / र्ावणवययक वर्वशिताओं को भरना होगा और उसे सेर् करना होगा। इसके बाद टेकिकि वबड पर वक्िक करना होगा। यकद यह एवलिके शन रन नहीं ककया जाता है, तो र्ेंडर अपनी

तकनीकी बोिी को सेर् / प्रस्तुत नहीं कर सकें गे ।

The vendor should allow running JAVA application. This exercise has to be done immediately after opening of Bid floor. Then they have to fill up Common terms/Commercial specification and save the same. After that click on the Technical bid. If this application is not run then the vendor will not be able to save/submit his Technical bid.

e) तकनीकी बोिी भरने के बाद, xxxxxx को अपनी तकनीकी बोिी दजव करने के विए 'सेर्' पर वक्िक करना होगा।

एक बार ऐसा करने के बाद xxxxxxxxx बोिी लििंक सकिय हो जाएगा और उसे भरना होगा और xxx अपनी र्ावणवययक बोिी दजव करने के विए र्ेंडर को "सेर्" पर वक्िक करना होगा। जब तकनीकी xxxx और xxxxxxxxx बोिी दोनों सेर् हो जाएिंगी, तब xxxxxx अपनी बोिी को दजव करने के विए "फाइनि सबवमशन"

बटन पर वक्िक करेगा।

After filling the Technical Bid, vendor should click ‘save’ for recording their Technical bid. Once the same is done, the Commercial Bid link becomes active and the same has to filled up and then vendor should click on “save” to record their Commercial bid. Then once both the Technical bid & Commercial bid has been saved, the vendor can

click on the “Final submission” button to register their bid.

f) र्ेंडरों को वनदशे कदया जाता है कक र्े दस्तार्ेज़ अपिोड करने के विए Attach Doc button का उपयोग करें। एकावधक दस्तार्ेज़ अपिोड ककए जा सकते ह।ैं Vendors are instructed to use Attach Doc button to upload documents. Multiple documents can be uploaded. g) अपनी बोिी प्रस्तुत करते समय र्ेंडर को सभी मामिों में वडवजटि हस्ताक्षर के साथ अपनी आईडी और पासर्डव का उपयोग करना चावहए। In all cases, vendor should use their own ID and Password along with Digital Signature at the time of submission of their bid. h) सिंपूणव ई-वनवर्दा प्रकिया के दौरान र्ेंडर पूरी तरह से एक-दसरे के विए और शेष सभी के विए भी गुमनाम रहगे During the entire e-tender process, the vendors will remain completely anonymous to one another and also to everybody else. i) ई-वनवर्दा फ्िेटफामव पूर्व घोवषत वतवथ और समय से और ऊपर बताई गई अर्वध तक के विए खुिा रहगा। The e-tender floor shall remain open from the pre-announced date & time and for as much duration as mentioned above. j) ई-वनवर्दा प्रकिया के दौरान प्रस्तुत सभी इिेक्रॉवनक बोवियािं र्ेंडरों पर कानूनी रूप से बाध्यकारी होंगी। ककसी भी xxxx को उस र्ेंडर द्वारा की गई र्ैध बोिी माना जाएगा और िे ता द्वारा उसे स्र्ीकृ त ककए जाने पर िे ता और र्ेंडर के बीच आपूर्तव के विए यह एक बाध्यकारी अनुबिंध हो जाएगा। All electronic bids submitted during the e-tender process shall be legally binding on the vendor. Any bid will be considered as the valid bid offered by that vendor and acceptance of the same by the Buyer will form a binding contract between Buyer and the Vendor for execution of supply. k) यह अवनर्ायव है कक सभी बोवियािं वडवजटि हस्ताक्षर प्रमाण पत्र के साथ प्रस्तुत की जाएिं अन्यथा वसस्टम द्वारा स्र्ीकार नहीं की जाएिंगी। It is mandatory that all the bids are submitted with digital signature certificate otherwise the same will not be accepted by the system. l) िे ता वबना कोई कारण बताए वनवर्दा को पूणव या भाग में रद्द करने या अस्र्ीकार करने या स्र्ीकार करने या र्ापस िेने या वर्स्ताररत करने, जैसा मामिा हो, का अवधकार रखता ह।ै Buyer reserves the right to cancel or reject or accept or withdraw or extend the tender in full or part as the case may be without assigning any reason thereof. m) वनवर्दा दस्तार्ेज के वनयमों और शतों में कोई वर्चिन स्र्ीकायव नहीं ह।ै ककसी भी र्ेंडर द्वारा ई-वनवर्दा लिेटफामव पर बोिी प्रस्तुत करना, उसके द्वारा वनवर्दा के वनयमों और शतों को स्र्ीकार करने की पुवि करता है No deviation of the terms and conditions of the tender document is acceptable. Submission of bid in the e-tender floor by any vendor confirms his acceptance of terms & conditions for the tender.

हमने एतदद्वारा ज्ञापन में वनर्दवि कायों से सिंबवधत वर्वनदशों, वडजाइनों तथा मात्राओं की अनुसूची की सार्धानीपूर्वक जािंच की है और उि ज्ञापन में वनधावररत स्थि का दौरा ककया है और एर्िं ई-वनवर्दा से

सिंबिंवधत समस्त आर्श्यक जानकारी प्राप्त की ह। हम एतदद्वारा उि ज्ञापन में वनधावररत कायों को ज्ञापन

के अनुसार वनधावररत समय-सीमा के भीतर सिंिग्न मात्रा अनुसूची में र्र्णवत दरों पर और अनुबिंध में वनर्दवि वर्वनदशो, वडज़ाइनों और विवखत अनुदेशों के अनुसार वनष्पाकदत करने का प्रस्तार् करते हैं जो हर प्रकार

से क़रारनामा, वनवर्दाकार के विए पूर्ोव्िवखत सामान्य अनुदेश और वर्शेष शतों, वर्वनदश, डेटा शीट

और मात्रा अनुसूची और यथा िागू अन्य शतों के अधीन उपिब्ध कराई जाने र्ािी सामग्री के अनुसार पूरा ककया जाएगा ।

We have carefully examined the specifications, designs and schedule of quantities relating to the works specified in the memorandum hereinafter set out and having visited and examined the installation site of the works specified in the said memorandum and having acquired the requisite information relating thereto as affecting the tender. We hereby offer to execute the works specified in the said memorandum within the time specified in the said memorandum at

the rates mentioned in the attached Schedule of Quantities and in accordance in all respects with specifications, designs and instructions in writing referred to in articles of agreement, general instructions to the tenderers and special conditions, conditions hereinbefore referred to, specifications, data sheet and schedule of quantities and with such materials as are provided for, by and in all other respects, in accordance with such conditions so far as they may be applicable.

खण्ड/ Section-II

र्ावणवययक शतें और कायव का दायरा: Commercial Conditions and Scope of Work:

1. वनवर्दाएिं बैंक द्वारा वनवर्दा (भाग I) खोिने की तारीख से 90 कदनों की अर्वध के विए स्र्ीकृ वत के विए र्ैध होंगी। The tenders shall be valid for acceptance by the Bank for a period of 90 days from the date of opening of Tender (Part I).

2. उद्धृत दरों में बैंक में कायव पूरा होने तक सभी करों, शु्कों, िेर्ी, उपभोग्य सामवग्रयों, श्रम, पररर्हन, पारगमन के विए बीमा, पैककिं ग आकद के शु्क शावमि होंगे।

The rates quoted shall include charges for all taxes, duties, levies, consumables, labour, transport, insurance for transit, packing, etc. till the completion of the work in all respect to the bank.

3. बैंक में एसी की वडिीर्री के दौरान होने र्ािी ककसी भी दघवटना/नुकसान/क्षवत के विए बैंक कोई दावयत्र् स्र्ीकार नहीं करेगा। आपूर्तव ककए गए उपकरण के मामिे में बैंक को उपकरण सौंपने की तारीख से एक र्षव की अर्वध के विए सभी प्रकार की खरावबयों के सिंबिंध में गारिंटी दी जाएगी। गारिंटी अर्वध के भीतर वसस्टम/उप-असेंबिी में पाए जाने र्ािे

ककसी भी दोष को वनवर्दाकताव द्वारा वनःशु्क सुधारा/प्रवतस्थावपत ककया जाएगा। इस अर्वध के दौरान, वनमावता द्वारा वनधावररत और पारस्पररक सहमवत के अनुसार त्रैमावसक अिंतराि पर या उससे पहिे सर्र्वलसिंग वनःशु्क की जाएगी Bank will not accept any liability for any mishap/accident/damage caused while delivery of the

AC’s in the bank. The equipment’ supplied shall be guaranteed against all types of defects for a period of one year from the date of handing over the equipment’s to the Bank. Any defects found in the system/sub-assemblies within the guarantee period shall be rectified/ replaced by the tenderer free of cost. During this period, servicing at quarterly interval or earlier, as prescribed by the manufacturer and as mutually agreed to, shall be carried out free of cost.

4. भुगतान की वनम्नविवखत शतें िागू होंगी:

Following terms of payments shall be applicable:

(a) सभी र्ैधावनक करों की कटौती के बाद कायव पूरा होने पर प्रमावणत रावश का 95%।

95 % of the certified amount on completion of work after deductions of all statutory taxes.

(b) प्रमावणत रावश का 5% बैंक द्वारा सुरक्षा जमा के रूप में रखा जाएगा जो वसस्टम के सिंतोषजनक कामकाज के अधीन दोष दावयत्र् अर्वध के एक र्षव के बाद जारी ककया जाएगा।

5% of the certified amount will be held in the form of security deposit by the Bank which will be releases after one year of Defect liability period subjected to the satisfactory working of the system.

5. समय अनुबिंध का सार ह। सपूणविं कायव स्र्ीकृ वत पत्र की तारीख के 10र्ें कदन से 2 महीने में पूरा ककया जाएगा। कायव

पूरा होने की अनुबिंध अर्वध से अवधक देरी के विए प्रवत सप्ताह बैंक की अनुमावनत िागत का 0.25% और अनुबिंध मू्य के अवधकतम 10% तक पररवनणीत हजावना र्सूि ककया जाएगा।

Time is the essence of the contract. Entire work shall be completed in 2 months from the 10th day of the date of letter of acceptance, failing which liquidated damages at the rate of 0.25 % of the Bank’s estimated cost per week to a maximum of 10% of the contract value will be recovered/ deducted for delay beyond the contractual period of completion.

6. मात्राओं की अनुसूची के र्ि सािंके वतक ह। कायव के वनष्पादन के दौरान ककसी भी र्स्तु की मात्रा बढ़ाने या घटाने या

ककसी र्स्तु को हटाने का अवधकार बैंक के पास सुरवक्षत ह।ै

The schedule of quantities is only indicative. The Bank reserves the right to increase or decrease the quantities for any items or to delete any item during execution of work.

7. वनवर्दाकारों को सिाह दी जाती है कक र्े बोिी िगाने से पहिे साइट का वनरीक्षण कर िें। यह आइटम रेट टेंडर ह

और सभी आइटम बैंक के इिंजीवनयर के वनदशानुसार वनष्पाकदत ककए जाने ह। स्थापना कायव जैसे कॉपर पाइलपिंग,

आउटडोर यूवनट स्टैंड, िकड़ी का काम, बढ़ईगीरी का काम, यकद आर्श्यक हो तो वड्रलििंग आकद के विए कोई अवतररि भुगतान नहीं ककया जाएगा।

Tenderers are advised to inspect the site before quoting. This is item rate tender and all items are to be executed as directed by Bank’s Engineer. No extra payment will be done for the installation work like copper pipping, outdoor unit stand, wooden work, carpentry work, drilling if required etc.

8. सिंवर्दाकार द्वारा सारे मिबे का वनपटान पररसर की सीमा के बाहर सिंबिंवधत स्थानीय अवधकाररयों के वनयमों और वर्वनयमों के अनुसार ककया जाएगा और साइट को असुरक्षा/आग के खतरों से मुि रखा जाएगा।

All debris shall be disposed of by the contractor as per the rules and regulations of local authorities concerned beyond the property limit sand the site shall be kept free of safety/ fire hazards.

9. सिंवर्दाकार र्ेतन भुगतान अवधवनयम, 1936 न्यूनतम र्ेतन अवधवनयम, 1948, अनुबिंध श्रम (वर्वनयमन और उन्मूिन) अवधवनयम, 1970 या इस सिंबिंध में िागू ककसी अन्य श्रम कानून/वर्वध के ककसी भी प्रार्धान के उ्ििंघन के विए सभी नुकसानों और दार्ों, क्षवत या मुआर्जे के वखिाफ बैंक को क्षवतपूर्तव देगा और क्षवतपूर्तव करता रहगा।

The contractor shall indemnify and keep indemnified the Bank against all losses and claims, damages or compensation for breach of any provision of the Payment of Wages Act, 1936 Minimum Wages Act, 1948, Contract Labour (Regulation and Abolition) Act, 1970 or any other labour law/statute in force in this regard.

10. सफि वनवर्दाकताव को एनईएफटी/नेट बैंककिं ग के माध्यम से भुगतान की गई ईएमडी के र्ि हमारे खाता सिंख्या

8714295, IFSC RBIS0JMPA01(0 = zero) भारतीय ररजर्व बैंक जम्मू में जमा करनी होगी। कृ पया कदए गए प्रारूप में आर्ेदन करते समय यूटीआर रासेक्शन वर्र्रण का उ्िेख करें।

नोट: कृ पया एनईएफटी िेनदेन रटलपणी में अपना नाम/किं पनी का नाम उ्िेख करें।

11. बैंक वबना कोई कारण बताए ककसी या सभी वनवर्दाओं को स्र्ीकार या अस्र्ीकार करने का अवधकार सुरवक्षत रखता ह।ै

The Bank reserves the right to accept or reject any or all the tenders without assigning any reason thereof.

12. वर्र्ाद: मध्यस्थता द्वारा वर्र्ादो ं का वनपटारा:

Disputes: Settlement of Disputes by Arbitration :

ककसी भी प्रकार के सभी वर्र्ाद और मतभेद, जो अनुबिंध से या उसके सिंबिंध में या कायों को पूरा करने से उत्पन्न होते हैं (चाहे कायों की प्रगवत के दौरान या उनके पूरा होने के बाद और चाहे अनुबिंध के पररत्याग या उ्ििंघन के वनधावरण से पहिे या बाद में) बैंक द्वारा सिंदर्भवत और वनपटान ककया जाएगा जो विवखत रूप में अपना वनणवय बताएगा। ऐसा वनणवय

अिंवतम प्रमाणपत्र के रूप में या अन्यथा हो सकता ह। ककसी भी अपर्ाकदत मामिे के सबधिंिं में बैंक का वनणवय अिंवतम होगा।

िेककन यकद सिंवर्दाकार ककसी भी मामिे पर असिंतुि ह, तो सिंवर्दाकार ऐसे वनणवय की सूचना प्राप्त करने के 28 कदनों क

भीतर दसरे पक्ष को एक विवखत नोरटस दे सकता है, वजसमें कहा गया है कक वर्र्ाद र्ािे मामिों पर मध्यस्थता की

जाए। ऐसे विवखत नोरटस में उन मामिों को वनर्दि ककया जाएगा, जो वर्र्ाद या मतभेद में हैं, वजनके बारे में ऐसा

विवखत नोरटस कदया गया ह। यकद दोनों पक्ष सहमत हों तो इस उद्देश्य के विए एक मध्यस्थ वनयुि ककया जाएगा। यकद

एकि मध्यस्थ की वनयुवि पर कोई सहमवत नहीं बन पाती है, तो दोनों पक्ष अपनी ओर से एक-एक व्यवि को मध्यस्थ के रूप में नावमत करेंगे। पार्टवयों द्वारा नावमत दो मध्यस्थ तीसरे मध्यस्थ या अिंपायर के रूप में कायव करने के विए एक और व्यवि को नावमत करेंगे। मध्यस्थ या मध्यस्थगण , जैसा भी मामिा हो, को पूर्वर्ती खिंड में सिंदर्भवत अपर्ाकदत

मामिों को छोड़कर, ककसी भी प्रमाणपत्र, राय, वनणवय, मािंग या नोरटस को खोिने, समीक्षा करने और सिंशोवधत करने

और वनधावररत करने की शवि होगी। मध्यस्थ या मध्यस्थगण, जैसा भी मामिा हो, अपना वनणवय एक र्षव के भीतर (या पार्टवयों की सहमवत से उसके या उनके द्वारा तय ककया जा सकने र्ािा अवतररि समय) देंगे। यकद मध्यस्थता की कायवर्ाही के दौरान पक्षकार आपसी सहमवत से अपने वर्र्ाद या मतभेद को सुिझा िेते हैं या समझौता कर िेते हैं, तो

पक्षकारों द्वारा समझौते या समझौते का सिंयुि ज्ञापन दायर करने पर, मध्यस्थ या मध्यस्थगण, जैसा भी मामिा हो, ऐसे वनपटान के सिंदभव में एक वनणवय देंगे । ऐसे ककसी भी सिंदभव पर, मामिे को सिंदर्भवत ककए जाने की प्रासिंवगक िागत

और तत्सिंबिंधी वनणवय मध्यस्थ या मध्यस्थों के वर्र्ेक पर होगा, जो दोनो पक्षों के बीच रावश और कर आकद के वर्भाजन

के सिंबिंध में यह वनदश सकें गे कक ककसके द्वारा और ककसको तथा ककस तरीके से उसका र्हन और भुगतान ककया जाएगा।

All disputes and differences of any kind whatever arising out of or in connection with the contract or the carrying out of the works (whether during the progress of the works or after their completion and whether before or after the determination abandonment or breach of the contract) shall be referred to and settled by the Bank who shall state its decision in writing. Such decision may be in the form of a final certificate or otherwise. The decision of the Bank with respect to any of the excepted matters shall be final. But if either the Contractor be dissatisfied on any matter the Contractor may within 28 days after receiving notice of such decision give a written notice to the other party requiring that the matters in dispute be arbitrated upon. Such written notice shall specify the matters, which are in dispute or difference of which such written notice has been given. If both the parties agree a single arbitrator would be appointed for the purpose. In case no agreement could be reached on the appointment of single arbitrator, both the parties will nominate one person each as an arbitrator on their behalf. The two arbitrators nominated by the parties shall nominate one more person to act as third arbitrator or umpire. The arbitrator or arbitrators, as the case may be, shall have power to open up, review and revise any certificate, opinion, decision, requisition or notice, save in regard to the excepted matters, referred to in the preceding clause, and to determine all matters to dispute which shall be submitted to arbitration and of which notice shall have been given as aforesaid. The arbitrator or arbitrators, as the case may be, shall make his or their award within one year (or such further extended time as may be decided by him or them as the case may be with the consent of the parties) from the date of entering on the reference. In case during the arbitration proceedings the parties mutually settle or compromise their dispute or difference, on the parties filing their joint memorandum of the settlement or compromise, the arbitrator or the arbitrators as the case may be, shall make an award in terms of such settlement or compromise. Upon any such reference, the decision on the cost incidental to the reference and award respectively shall be in the discretion of the arbitrator or arbitrators as the case may be., who may determine the amount thereof or direct the same to be taxed as between the party and party, and shall direct by whom and to whom and in what manner the same shall be borne and paid.

इस प्रस्तुवतकरण को भारतीय मध्यस्थता और सुिह अवधवनयम, 1996 या उसके ककसी भी र्ैधावनक सिंशोधन के अथव में

मध्यस्थता के विए प्रस्तुतीकरण माना जाएगा। मध्यस्थ या मध्यस्थों का वनणवय, जैसा भी मामिा हो, अिंवतम होगा और पार्टवयों पर बाध्यकारी होगा। इस बात पर सहमवत है कक ठेके दार ऐसे ककसी भी मामिे, प्रश्न या वर्र्ाद को मध्यस्थता

के विए भेजे जाने के कारण काम को पूरा करने में देरी नहीं करेगा, बव्क पूरे पररश्रम के साथ काम को आगे बढ़ाएगा और मध्यस्थ या मध्यस्थ के वनणवय तक बैंक के वनणवय का पािन करेगा। मध्यस्थ या मध्यस्थ का कोई भी वनणवय, जैसा

भी मामिा हो, सिंवर्दाकार को कायों के र्ास्तवर्क कियान्र्यन के सिंबिंध में बैंक के वनदशों का सख्ती से पािन करने के

उसके दावयत्र्ों से मुि नहीं करेगा। वनयोिा और सिंवर्दाकार इस बात से भी सहमत हैं कक इस खिंड के तहत मध्यस्थता अनुबिंध के तहत कारवर्ाई के ककसी भी अवधकार के विए एक शतव होगी।

This submission shall be deemed to be a submission to arbitration within the meaning of the Indian Arbitration and Conciliation Act, 1996 or any statutory modification thereof. The award of the arbitrator or arbitrators, as the case may be, shall be final and binding on the parties. It is agreed that the Contractor shall not delay the carrying out of the works by reason of any such matter, question or dispute being referred to arbitration, but shall proceed with the works with all due diligence and shall until the decision of the arbitrator or arbitrators is given, abide by the decision of the Bank. No award of the arbitrator or arbitrators, as the case may be, shall relieve the Contractor of his obligations to adhere strictly to the Bank's instructions with regard to the actual carrying out of the works. The Employer and the Contractor hereby also agree that arbitration under this clause shall be a condition precedent to any right of action under the contract.

13. भारतीय ररज़र्व बैंक न्यनतम या ककसी भी वनवर्दा को स्र्ीकार करने के विए बाध्य नहीं है और ऐसा करने के विए

कोई कारण बताए वबना ककसी या सभी वनवर्दाओं को पणव या आवशकिं रूप से स्र्ीकार या अस्र्ीकार करने का अवधकार

सुरवक्षत रखता ह। बैंक वनवर्दाकताव द्वारा उद्धृत समान कीमतों पर वनवर्दा को पूणव या आिंवशक रूप से स्र्ीकार करने

का अवधकार सुरवक्षत रखता ह।

यकद फमव द्वारा उद्धृत मेक/मॉडि बैंक द्वारा आर्श्यक तकनीकी वर्वनदश

के अनुसार

नहीं ह, तो इस वस्थवत में बैंक द्वारा बोिी सीधे खाररज कर दी जाएगी।

The Reserve Bank of India does not bind itself to accept the lowest or any tender and reserve the right itself to accept or reject any or all the tenders, either in whole or in part, without assigning any reasons for doing so. The Bank reserves the right to accept the tender either in whole or in part at the same prices quoted by the Tenderer. If the make/ model quoted by the firm is not as per the technical specification required by the Bank, then in this case the bid will directly be rejected by the Bank.

वजस वनवर्दाकार की वनवर्दा स्र्ीकार नहीं की गई है, र्ह वनवर्दा जमा करने या उसके सिंबिंध में उसके द्वारा ककए गए ककसी भी िागत, शु्क, क्षवत और व्यय का दार्ा करने का हकदार नहीं होगा, जबकक बैंक वनवर्दा को सिंशोवधत / र्ापस

िेने का वर्क्प चुन सकता ह।ै

The tenderer whose tender is not accepted shall not be entitled to claim any costs, charges,

damages and expenses of and incidental to or incurred by him through or in connection with his submission of tenders, even though the Bank may elect to modify/withdraw the tender.

14. कायवस्थि पर मवहिाओ ं का यौन उत्पीड़न

Prevention of Sexual Harassment of women at workplace:

कायव स्थि पर मवहिाओं का यौन उत्पीड़न (वनर्ारण, प्रवतषेध और प्रवततोष) अवधवनयम 2013 के प्रार्धानों के अनुपािन सिंवर्दाकार/एजेंसी पूरी तरह से वजम्मेदार होगा।

The Contractor / Agency shall be solely responsible for full compliance with the provision of “the

Sexual Harassment of women at workplace (Prevention, Prohibition and Redressal) Act, 2013.

a. बैंक पररसर के भीतर अपने कमवचारी के वखिाफ यौन उत्पीड़न की ककसी भी वशकायत के मामिे में सिंवर्दाकार/एजेंसी

द्वारा गरठत आिंतररक वशकायत सवमवत के समक्ष वशकायत दजव की जाएगी और वशकायत के सिंबिंध में सिंवर्दाकार/एजेंसी उि अवधवनयम के अिंतगवत उवचत कारवर्ाई सुवनवित करेगा ।

In case of any complaint of sexual harassment against its employee within the premises of the Bank, the complaint will be filed before the Internal Complaints Committee constituted by the Contractor / Agency and the Contractor / Agency shall ensure appropriate action under the- said Act in respect to the complaint.

b. यकद सिंवर्दाकार के ककसी पीवड़त कमवचारी से बैंक के ककसी कमवचारी के वर्रुि यौन उत्पीड़न की वशकायत प्राप्त होती है, तो उस पर बैंक द्वारा गरठत क्षेत्रीय वशकायत सवमवत द्वारा सिंज्ञान विया जाएगा।

Any complaint of sexual harassment from any aggrieved employee of the contractor against any employee of the Bank shall be taken cognizance of by the Regional Complaints Committee constituted by the Bank.

c. यकद यौन उत्पीडन की घटना में सिंवर्दाकार का कमवचारी शावमि रहता है और सिंवर्दाकार के कमवचारी द्वारा यौन

लहसा ककया जाना वसि हो जाता है तो इस हतु देय ककसी प्रकार की मौकिक क्षवतपूर्तव हतु सिंवर्दाकार वजम्मेदार होगा

।

The contractor shall be responsible for any monetary Compensation that may need to be paid in case the incident involves the employees of the contractor, for instance any monetary relief to Bank’s employee, if sexual violence by the employee of the contractor is proved.

15. अप्रकटीकरण खिंड / Non-Disclosure:

सिंवर्दाकार प्रत्यक्ष अथर्ा परोक्ष रूप से ऐसी कोई भी सूचना, सामग्री और बैंक की आधारभूत सिंरचना/ प्रणािी/ उपकरण

आकद का वर्र्रण जो इस करार से जुड़े अपने दावयत्र्ों का वनर्हन करते समय उसके कब्जे या सिंज्ञान में आई हों, ककसी

अन्य पक्ष के साथ साझा नहीं करेगा और हर समय उसे अत्यिंत गोपनीय रखेगा। सिंवर्दाकार करार के वर्र्रण उस सीमा तक वनजी और गोपनीय रखेगा जब तक कक इसके तहत दावयत्र्ों का वनर्वहन करने अथर्ा प्रयोयय कानूनों के पािन हतु अन्यथा अपेवक्षत न हो । सिंवर्दाकार वनयोिा की विवखत पूर्ावनुमवत के वबना कायव के ककसी भी वर्र्रण को ककसी

खुिासा करेगा। ककसी गोपनीय सूचना के प्रकटन के कारण वनयोिा को होने र्ािे नुकसान हतु सिंवर्दाकार द्वारा वनयोिा को क्षवतपूररत ककया जाएगा। उपयुवि का पािन करने में वर्फिता को सिंवर्दाकार के स्तर से सिंवर्दा का उ्ििंघन माना जाएगा और वनयोिा को हक होगा कक र्ह हुए नुकसान का दार्ा करे और कानूनी कारवर्ाई शुरू कर दे। सिंवर्दाकार अपने कमवचाररयों के सिंबिंध में सभी उपयुि कारवर्ाई करेगा तथा सुवनवित करेगा कक इस करार के अिंतगवत गोपनीय सूचना के गैर-प्रकटीकरण के दावयत्र् का पूणवतःपािन हो रहा हो। अप्रकणीकरण और गोपनीयता सिंबिंधी सिंवर्दाकार की बाध्यता

The contractor shall not disclose directly or indirectly any information, materials and details of the Bank’s infrastructure/ system / equipment’s etc. which may come to the profession or knowledge of the contractor during the course of discharging its contractual obligations in connection with the agreement, to any third party and shall at all times hold the same in strictest confidence. The contractor shall treat the details of the contract as private and confidential, except to the extent necessary to carry out the obligations under it or to comply with applicable laws. The contractor shall not publish, permit to be publish, or disclose ant particulars of the works in any trade or technical paper or elsewhere without the previous written consent of the Employer. The contractor shall indemnify the Employer for any loss suffered by the Employer as a result of disclosure of any confidential information. Failure to observe the above shall be treated as breach of contract on the part of the contractor and the Employer shall be entitled to claim damages and pursue legal remedies. The contractor shall take all appropriate actions with respect to its employees to ensure that the obligations of non-disclosure of confidential information under this agreement are fully satisfied. The contractor’s obligations with respect to non-disclosure and confidentiality will survive the expiry or termination of this agreement for whatever reason.

16. A bidder is liable for debarment/disqualification from bidding on the following grounds:

1. If it is determined that the bidder has committed the following acts or omissions in contravention of the code of integrity:

a. making offer, solicitation or acceptance of bribe, reward or gift or any material benefit, either directly or indirectly, in exchange for an unfair advantage in the procurement process or to otherwise influence the procurement process.

b. any omission or misrepresentation that may mislead or attempt to mislead so that financial or other benefit may be obtained, or an obligation avoided.

c. any collusion, bid rigging or anticompetitive behaviour that may impair the transparency, fairness and the progress of the procurement process.

d. improper use of information provided by the procuring entity to the bidder with an intent to gain unfair advantage in the procurement process or for personal gain.

e. any financial or business transactions between the bidder and any official of the procuring entity related to tender or execution process of contract: which can affect the decision of the procuring entity directly or indirectly.

f. any coercion or any threat to impair or harm, directly or indirectly, any party or its property to influence the procurement process.

g. obstruction of any investigation or auditing of a procurement process.

h. making false declaration or providing false information for participation in a tender process or to secure a contract;

i. failed to disclose conflict of interest

failed to disclose any previous transgressions made in respect of the provisions of sub- clause (i) with any public institution / entity in India or any other country during the last three years or of being debarred by any public procuring institution / entity.

2. For any actions or omissions by the bidder other than violation of code of integrity, which in the opinion of the Bank warrants debarment, for the reasons like supply of sub-standard material, non-supply of material, abandonment of works, sub-standard quality of works, failure to abide terms of the tender etc.

3. If the bidder has been convicted of an offence— (a) under the Prevention of Corruption Act, 1988; or (b) the Indian Penal Code or any other law for the time being in force, for causing any loss of life or property or causing a threat to public health as part of execution of a public procurement contract.

WHEREAS the Employer is desirous of Supply Installation, Testing and Commissioning of Split/Cassette type Air Conditioners in Staff Canteen, Annexe Building, RBI Jammu and has caused drawings and specifications describing the work to be done. AND

WHEREAS the said Drawings from Numbers   to   , the specifications, and the

schedule of quantities have been signed by or on behalf of the parties hereto.

AND WHEREAS the Contractor has agreed to execute upon the subject work to the conditions set forth herein and to the conditions set forth in the special conditions and

in the schedule of quantities and conditions of Contract as modified and finally accepted by both the parties (all of which are collectively hereinafter referred to as "the said Conditions") the works shown upon the said drawings and/or described in the said Specifications and included in the Schedule of quantities at the respective rates therein set forth, amounting to the sum as therein arrived at or such other sum as shall become payable there under (hereinafter referred to as "the said Contract Amount").

In consideration of the said Contract amount to be paid at the times and in the manner set forth in the said conditions, the Contractor shall, upon and subject to the said conditions, execute and complete the work shown upon the said drawings and described in the said specifications and the schedule of quantities.

1.1 वनयोिा सिंवर्दाकार को सिंवर्दागत कायों के वनष्पादन के विए इस सिंवर्दा में उद्धृत रावश या ऐसे अन्य योग का भुगतान करेगा जो उस समय देय हो या शतों में वनर्दवि की गई हों।

The Employer shall pay the Contractor the said Contract amount or such other sum as shall become payable at the times and in the manner specified in the said conditions.

1.2 उि शतों में "आर्कव टेक्ट" शब्द का तात्पयव मुख्य महाप्रबिंधक, पररसर वर्भाग, कें िीय कायविय, भारतीय ररज़र्व बैंक, मुिंबई से होगा और ककसी भी कारणर्श इस अनुबिंध के प्रयोजन हतु यकद र्े आर्कव टेक्ट नहीं

रहते हैं तो इस हतु वनयोिा द्वारा उनके स्थान पर अन्य व्यवि या व्यवियों को नावमत ककया जाएगा,

िेककन ऐसा व्यवि नावमत नहीं ककया जाएगा वजस पर ऑवडटर को आपवि हो और वनयोिा उसकी आपवियों से सहमत हो । साथ ही इस अनुबिंध के तहत आर्कव टेक्ट के रूप में नावमत अथर्ा बाद में नावमत ककए जाने र्ािे व्यवि या व्यवियों को आर्कव टेक्ट द्वारा विवखत रूप में कदए गए ककसी भी वपछिे वनणवय

या अनुमोदन या वनदश की अर्हिना करने या इसके वर्रुद्द वनणवय देने का हक नहीं होगा ।

The term "Architect" in the said conditions shall mean CGM, Premises Department, Central Office, Reserve Bank of India and on his ceasing to be the architect for the

purpose of this Contract for whatever reason, such other person or persons as shall be nominated for that purposes by the Employer, not being a person to whom the Contractor shall object for reasons considered to be sufficient by the Employer PROVIDED ALWAYS that no person or perhaps persons subsequently appointed to be architect under this Contract shall be entitled to disregard or overrule any previous decisions or approval or direction given or expressed in writing by the architect for the time being.

1.3 इस अनुबिंध के वनयम और पररवशि इस करार के वहस्से के रूप में पढे जाएिंगे और समझे जाएिंगे और दोनों पक्षकार इसका पािन करेंगे, स्र्यिं को शतों के अनुसार प्रस्तुत करेंगे और वनवहत शतों का पािन करेंगे ।

The said Conditions and Appendix thereto shall be read and construed as forming part of this agreement and the parties hereto shall respectively abide by, submit themselves to the said conditions and perform the agreements on their part respectively in the said conditions contained.

1.4 इसमें उव्िवखत ड्राइिंग, करार और दस्तार्ेज़ इस अनुबिंध के आधारभूत घटक होंगे ।

The drawings, agreement and documents mentioned herein shall form the basis of this Contract.

This Contract is deemed to be item rate Contract for all items of work as described in detail in the bill of quantities and specifications in part I and Part II of the tender documents.

1.6 सिंवर्दाकार वसवर्ि कायों, वर्द्युत प्रवतष्ठानों, कफटटिंग और अन्य सहायक कायों से सिंबिंवधत सभी कायों को उि शतों में वनधावररत तरीके से करने के विए हर उवचत सुवर्धा का खचव र्हन करेगा, और ऐसे कायों के पूरा होने के बाद दीर्ारों, फशव आकद को हुए ककसी भी नुकसान की भरपाई करेगा ।

The Contractor shall afford every reasonable facility for carrying out of all works relating to civil works, electrical installations, fittings and other ancillary works in the manner laid down in the said conditions, and shall make good any damages done to walls, floors, etc., after the completion of such works.

1.7 वनयोिा इस अनुबिंध पर प्रवतकू ि प्रभार् डािे वबना, अनुबिंध की अर्वध के दौरान ककसी भी समय काम के

ककसी भी आइटम को जोड़ने या छोड़ने या उसी के कु छ वहस्सों को शावमि करके ड्राइिंग और काम की प्रकृ वत को बदिने का अवधकार सुरवक्षत रखता है ।

The Employer reserves to itself the right of altering the drawings and nature of the work by adding to or omitting any items of work or having portions of the same carried out at any time during the currency of Contract, without prejudice to this Contract.

1.7.1 समय को इस अनुबिंध का सार माना जाएगा और सिंवर्दाकार एतद्द्वारा उि शतों के अनुसार कायव आदेश/स्र्ीकृ वत पत्र जारी होने के कदन से काम शुरू करने और पूरे काम को समय के वर्स्तार के प्रार्धानों के अधीन कायावदेश जारी होने के 10 र्े कदन के 3 महीनों के भीतर पूरा करने के विए

सहमत ह।ै

1.7.2 Time shall be considered as the essence of this Contract and the Contractor hereby agrees to commence the work from the day of issue of works order/letter of acceptance as provided for in the said conditions and to complete the entire work within 3 months from 10th day of issue of work order subject nevertheless to the provisions for the extension of time.

1.7.3 इस अनुबिंध के तहत वनयोिा द्वारा सभी भुगतान के र्ि भारतीय ररजर्व बैंक, जम्मू में ककए जाएिंगे।

All payments by the Employer under this Contract will be made only at Reserve Bank of India, Jammu.

1.7.4 इस अनुबिंध से जुड़े या ककसी भी तरह से उत्पन्न होने र्ािे सभी वर्र्ादों को जम्मू में उत्पन्न माना जाएगा और इसे वनधावररत करने के विए के र्ि जम्मू के न्यायाियों का अवधकार क्षेत्र होगा ।

All disputes arising out of or in any way connected with this agreement shall be deemed to have arisen in Jammu and only courts Jammu shall have jurisdiction to determine the same.

1.7.5 इस अनुबिंध के सभी भागों को सिंवर्दाकार ने पढ़ विया है और सिंवर्दाकार द्वारा पूरी तरह से समझ विया गया ह।ै

Safety Code

1. First-aid appliances, including adequate supply of sterilized dressings and cotton wool, shall be maintained in a readily accessible place by the Contractors.

2. The contractor shall provide necessary face masks, globes and other necessary protective coverings to their workers if advised by the government to contain spread of COVID-19.

3. An injured person shall be taken to a public hospital without loss of time by the Contractor, in cases where the injury necessitates hospitalisation.

4. Suitable and strong scaffolds should be provided for workmen for all works that cannot safely be done from ground.

5. No portable single ladder shall be over 8 meters in length, the width between the side rails not less than 30 cm (clear) and the distance between two adjacent rungs shall not be more than 30 cm. When a ladder is used, an extra mazdoor shall be engaged for holding the ladder.

6. Every opening in the floor of a building or a working platform shall be provided with suitable means to prevent the fall of persons or materials by providing suitable fencing or railing whose minimum height shall be one metre.

7. No floor, roof or other part of the structure shall be as over-loaded with debris or materials as to render it unsafe.

8. Workers employed on mixing and handling materials (such as asphalt, cement, mortar or concrete, lime mortar, cleaning materials, paints & primer etc.) shall be provided with protective footwear, rubber hand-gloves, etc.

9. Those engaged in welding works shall be provided with welder’s protective eye-shields and gloves.

10. No paint containing lead or lead products shall be used except in the form of paste or readymade paint.

11. Suitable face masks should be supplied for use by the workers when the paint is applied in the form of spray or surface having lead paint dry rubbed and scrapped.

12. All the workers shall wear helmet & safety belts while working at site.

13. Hoisting machines and tackles used in the work, including their attachments, anchorage and supports shall be in perfect condition.

14. The ropes used in hoisting or lowering material or as a means of suspension shall be of durable quality and adequate strength and free from defects.

15. This is an occupied premises and access to site will be provided based on convenience of the Bank.

FIRE SAFETY CODE

i. Cutting / drilling machine and other electrically operated equipment used at site shall be plugged into correctly rated electrical outlets.

ii. Only ISI marked 3-pin plug and other appliances and equipment shall be used.

iii. Electrical power cables/wires used shall not have any joints and shall be properly rated.

iv. All electrical appliances i.e. welding, drilling, cutting machine etc. shall be safely and securely earthed to prevent leakage current while in operation.

v. Two buckets of water and sand shall be kept in an easily accessible area on the site.

vi. Fire extinguishers recommended shall be kept on the site. Used paint drums shall be stored in specified store only after closing them properly.

vii. Personal protective equipment such as safety shoes, hand gloves, welder’s mask, ear plug etc. depending upon the requirement of the work shall be provided by the contractor to the workmen to prevent occupational health hazards.

viii. The safety belt shall be provided by the contractor and used by the workmen while working from height for more than 10 feet from Ground level.

ix. None of the passages near lift lobby and staircases lobby shall be used for stacking / dumping any kind of materials/waste.

x. None of the fire extinguishers shall be removed/shifted from its designated location.

xi. Power supply shall be switched off from the mains when equipment is not in use.

xii. Any debris generated from the work shall be collected on daily basis, removed from site and stored at the designated place in proper manner.

Section V : SPECIAL CONDITIONS

1. The workmen will not be allowed to stay within the premises.

2. The electric power required for the work can be drawn from the supply available at site at free of cost. The Contractor has to make his own arrangements to take the supply to the requisite position.

3. The intending tenderer can obtain any clarifications regarding the e-tender drawings, specifications etc. if any from the office of the Regional Director, Reserve Bank of India Estate Department, JAMMU on any Bank’s working day.

4. The debris/dust or any wastage generated out of the above work shall be cleaned as frequently as required and as instructed by the Bank’s Engineer and make the entire area clear.

5. Bank reserves the right to insist on selection of material, workmanship, detailing and finishes, which they consider, are appropriate, and suitable for the intended use. The contractor is not eligible to claim extra on this account.

6. Any inconsistent deviation is found while on execution between the specification and drawings it is to be expressively noted that the specification prevails well and supersede the drawings.

7. The tenderer should note that he should execute his part of work without causing any damage to any component of the building and also without disturbing the existing occupants. Any damage so caused shall be made good at the cost & risk of the e-tender.

8. The tenderer should note the e-tender drawings and other documents describing each item in the schedule are only indicative in nature and cannot be taken as complete in detail and finishes. Being e-tender for interior works which calls for workmanship and finish including use of good quality materials of high standard, it is expected that the tenderer should understand the intent of the e-tender drawings and specifications and provide for materials, workmanship, finishes and accessories appropriately so as to deliver the product of high standards in keeping with the function for which the furniture is intended. No claim from the contractor at a later date will be entertained for his failure to understand this condition. The decision of the Bank in respect of the quality of material, type of work,

workmanship, finish etc., shall be final and binding on the contractor. The contractor’s claim for not providing in his e-tender for such materials, workmanship and finish cannot be entertained.

9. The successful contractor shall make sure that they protect their materials and hand them over in good shape to the Bank satisfactorily. At the time of handing over any damages, scratches, dents or such defects noticed shall be got rectified as directed without any extra charge by the Contractor to the satisfaction of the Bank.

10. The successful tenderers shall include, in the quoted price, all allied civil works such as chasing in wall, drilling holes etc., make the surface good after grouting etc.

11. Neat housekeeping at all times is the responsibility of the successful tenderer, who shall also ensure that the removal of debris, waste materials etc. from the site at their own cost and the same shall be organized at regular basis.

12. The successful contractor shall also be responsible for the safety and security of all their materials and for ensuring fire prevention steps at all times in the residential premises including their part of the work.

13. The contractors also have to subject themselves to the security restrictions imposed by the Bank.

Scope of the Work:

1. All the Ac’s delivered will be installed at vendor’s end which will include all the fitting charges including copper pipe, wiring, drain pipe outlet, wall/ floor stand for installation of outdoor unit as well as for window AC as per requirement. It also includes carpentry (all civil work) and welding work if required at locations.

2. Scope of work also include buyback of old AC.

3. The firm should submit the Catalogue of the Quoted make.

4. The firm shall provide warranty as per the OEM standard.

5. The firm shall visit the site before quoting the rates for proper understanding the scope of work as per the site requirement.

6. The firm shall carry out complete restoration of site as per the same previously as required complete in all respect as per the site requirement & as directed by the Bank.

7. The firm shall remove all the debris from the site.

8. The above rate shall include complete work i.e. Supply, Installation, testing, Commissioning and handover to the Bank.

9. The Bank reserves full right to reject any bid without giving any prior information/notice.
