Prawo właściwe. (a) Umowa i wszystkie czynności z niej wynikające lub z nią powiązane będą regulowane przez przepisy prawa polskiego. Zmiana lub uzupełnienie niniejszej Umowy dla swej ważności wymaga zachowania formy pisemnej. Zastrzeżenie: każde postanowienie niniejszej Umowy, które: (i) jest ujęte w pełnym brzmieniu lub przez odniesienie do federalnych przepisów dotyczących zamówień publicznych (ang. Federal Acquisition Regulation) (FAR) lub: (ii) jest ujęte w pełnym brzmieniu lub przez odniesienie do dowolnej regulacji agencji, która wdraża lub uzupełnia FAR; (iii) zasadniczo opiera się na takich regulacjach agencji lub regulacjach FAR; należy rozumieć i interpretować zgodnie z federalnym prawem powszechnym dotyczącym umów rządowych Stanów Zjednoczonych sformułowanym i stosowanym przez federalne organy sądowe, komisje odwoławcze do spraw umów i quasi-sądowe agencje Rządu federalnego USA. This supplemental clauses will apply to contracting with foreign entity if application thereof results from Contract (as defined below). Expressions defined in CORPDOC 3INTL have meaning ascribed thereto in CORPDOC 3INTL, unless otherwise expressly set forth in this document. “LOCKHEED MARTIN" means Polskie Zakłady Lotnicze Sp. z o.o. having seats in Mielec, address: Xxxxxx Xxxxxxxxx 0, 00- 000 Xxxxxx, Xxxxxx. "Contract" means the instrument of contracting, such as "Purchase Order", "PO", "Subcontract", or other type of document which contains information about the implementation of CORPDOC 3INT and their supplementary provisions. 1.ACCEPTANCE OF CONTRACT/TERMS AND CONDITIONS (c) Unless expressly accepted in writing by LOCKHEED MARTIN, additional or differing terms or conditions proposed by SELLER or included in SELLER's acknowledgment are objected to by LOCKHEED MARTIN and have no effect. Provisions of Article 385⁴ of the Civil Code does not apply. 2. APPLICABLE LAWS (a) Contract and any matter arising out of or related to this Contract shall be governed by the laws of Poland. Changes or additions to this Contract require written form for their validity. Exception: any provision in this Contract that is: (i) incorporated in full text or by reference from the Federal Acquisition Regulation (FAR) or: (ii) incorporated in full text or by reference from any agency regulation that implements or supplements the FAR or; (iii) that is substantially based on any such agency regulation or FAR provision, shall be construed and interpreted according to the federal common law of government contracts as enunciated and applied by federal judicial bodies, boards of contracts appeals, and quasi-judicial agencies of the federal Government.
