Substitute car. In case when travelling abroad there is a failure of the car in which the Insured is travelling, ERV shall reimburse the costs of renting a substitute car up to the amount of 50 EUR per day during the period of 5 days at the most. The Insured is obliged to submit appropriate documents confirming the occurence of the failure and the period of the car immobilisation. The upper limit of liability is the limit of all incidents in the insurance period, which means that each payment under substitute car decreases this amount up to its total exhaustion. Active Assistance § 114 Costs of renting equipment In case when during a foreign travel the Insured is deprived of the possibility of using the insured ski or sports equipment for reasons specified in § 73, ERV shall cover the costs of renting ski or sports equipment on the basis of original receipts in the amount of up to 15 EUR per day for the period of 7 days at the most.
Substitute car. Subject to the provisions of section 17 below, in case of the oc- currence of the indemnifiable accident, for the time of repairing the vehicle, at the request of the driver, ERV shall organise and cover the costs of renting one substitute car corresponding to the class of the vehicle at the most, though not higher that class C (e.g. Ford Focus, Toyota Auris, Renault Megane), with the re- striction of the limits set out in section 4 point 3) above. ERV shall be exempt from the duty of providing the benefit, if the Insured does not fulfil all the conditions required from per- sons renting a car by the car rental company, including not pro- viding surety or deposit to cover potential damage to the rented car. ERV shall not cover costs of the use of the rented substitute car (e.g. fuel, highway fees, extra payment for exceeding the limits of kilometres set out by the car rental company etc.) The benefit in the form of a substitute car shall be provided where possible. ERV is not obliged to provide substitute cars of identical specification in terms of model and equipment as the vehicle (e.g. diesel engine, kombi, automatic gear, audio system, automatic air-conditioning, 4X4 drive). In case of lack of possibility to organise a substitute car rental by the Operator, following their consent, the Insured may inde- pendently rent a substitute car and cover the costs of it on their own, at the most however, up to the amount of 100 EUR per day of rental. These costs shall be reimbursed by ERV under the scope of insurance protection in accordance with relevant provi- sions of §123.
