Settlement of Disputes. In case of a dispute related with the Agreement and the Loan, the Customer may firstly apply to the Bank. The Customer may, in case of failure to receive a result from an application to the Bank or directly, apply to the Arbitration Committee for Consumer Problems, the Participation Banks Association of Turkey Customer Complaints Arbitration Board or the Consumer Court pursuant to the provisions of the related applicable laws. The Parties may also have recourse to the alternative remedies like mediation. The Parties acknowledge that Istanbul (Çağlayan) Courts and Execution Offices shall have jurisdiction for settlement of any disputes arising between them. This agreement does not prejudice the jurisdiction of general courts and enforcement offices. Particularly, the courts and execution offices in the locality where the Bank has a physical branch also have the right of jurisdiction for settlement of disputes.
Settlement of Disputes. The client shall be able to apply to the Bank in case of any disputes regarding the Agreement and the Credit. The Client shall also be able to apply to the Consumer Arbitration Committee, the Turkish Participation Banks Association Customer Complaints Arbitration Committee or the Consumer Court in accordance with the provisions of the relevant legislation in case there are no results after the application to the Bank. The Parties shall also have the right to apply to alternative settlement means such as mediation. The Parties agree that Istanbul (Çağlayan) Courts and Enforcement Offices shall be authorised for the settlement of any disputes in between. This Agreement does not relieve the authority of the general courts and enforcement offices. Settlement of Disputes. In case of all disputes, the Turkish law and Turkish version of agreement shall become valid, and the "Istanbul Courts" and "Execution Offices" shall be exclusively authorized and in this regard, the commercial records and books of HCE shall be accepted as exclusive evidence pursuant to 193rd Clause of Code of Civil Procedure.
Settlement of Disputes. In the event of any disputes arising out of or in connection with the Agreement and the credit, the Customer may apply to Emlak Katılım first. In case he/she achieves no result from the application to the Bank or at his/her own discretion, he/she can directly apply to Arbitration Committee for Consumer Problems, Participation Banks Association of Turkey Arbitration Committee for Customer Complaints or Consumer Courts within the scope of relevant legislation provisions. Parties have right to apply to alternative remedies such as mediation/arbitration. Parties agree that Istanbul Anatolian Courts and Enforcement Offices shall have jurisdiction for the settlement of disputes. This Agreement shall not abolish the power and authority of general courts and enforcement offices. The Courts and Enforcement Offices, located in places where Emlak Katılım actually has a branch, shall also have jurisdiction for the settlements of disputes.
