In any event, if the Force Majeure Event causes the delivery under this Contract to be delayed for more than thirty (30) days, either Party shall be entitled to terminate this Order without incurring any liability for breach.
If any party is unable to perform its obligations under this Order as a result of a Force Majeure Event, the performance of its obligations shall be suspended while the Force Majeure Event subsists, and the due date for the performance shall be automatically extended for a period equal to such suspension.
After the occurrence of a Force Majeure Event, the Parties shall promptly discuss with each other to find an equitable solution and shall use reasonable efforts to mitigate the consequences of the Force Majeure Event.

Surfly shall not be liable to you, your Agents, End Users or any other person for any delay or failure in the performance of the Agreement or for loss or damage of any nature whatsoever suffered by you or such persons due a Force Majeure Event as defined herein.
