Проверка упаковки. По письменному запросу Покупателя проверка внешней упаковки и тары Товара, которое должно быть отгружено, в соответствии с разумной практикой деловых отношений может быть проведена Покупателем (самостоятельно или с помощью агента) в присутствии Продавца на заводе-изготовителе до Даты поставки в соответствие со временем, приемлемым для Покупателя; такая проверка ограничивается визуальной проверкой очевидных физических повреждений упаковки, несоблюдение внешней упаковки или материалов тары условиям Статьи 4. настоящего Соглашения или очевидных количественных несоответствий или иных несоответствий упаковки или тары, при условии, что Продавец не несет ответственности за несвоевременность поставки Товара, если агент Покупателя не явился в приемлемое для Покупателя время по какой бы то ни было причине. Если проверка выявит какие-либо физические повреждения упаковки, несоответствие внешней упаковки или материалов тары Разделу 4. настоящего Соглашения или количественные несоответствия упаковки или тары, Продавец должен исправить такие повреждения, несоответствия или количественные несоответствия за счет Продавца; при этом в случае задержки поставки Товара из-за (i) выявленных физических повреждений упаковки, несоответствий внешней упаковки или материалов тары Разделу 4. настоящего Соглашения или количественных несоответствий упаковки или тары и (ii) времени, необходимого Продавцу для устранения выявленных физических повреждений упаковки, несоответствий внешней упаковки или материалов тары Разделу 4. настоящего Соглашения или количественных несоответствий упаковки или тары, Продавец несет ответственность за несвоевременность поставки Товара.

  • Absence Without Permission (a) An Employee who is absent from her employment without permission for ten (10) consecutive days, shall be deemed to have resigned her position effective the first day of her absence.

  • Acting Capacity ‌ When an employee is assigned temporarily to a job for which he/she is qualified in a higher pay grade for a period of five (5) days or his/her regular workweek, whichever is less, the employee shall be paid retroactively from the initial date of the temporary transfer for the duration of the temporary assignment. The employee shall be paid as if he/she had been promoted during such assignment. In no event may an employee acquire any status in a higher classification as a result of his/her temporary assignment. Acting capacity assignments shall not be made on an arbitrary or capricious basis. Employees shall not be rotated in acting capacity in an arbitrary or capricious manner in order to avoid payment of acting capacity pay. This Article shall not be used in lieu of the proper processing of any request for reclassification or reallocation of a position pursuant to Article 48, Reclassifications, or the filling of a vacancy pursuant to Article 56, Seniority.

  • ASSIGNING OR SUB-LETTING OF CONTRACT This Contract shall not be assigned nor sublet by the Contractor or Surety without prior written consent thereto of the Board.

  • No Removal or Substitution The Resident may not remove, alter or change any property in the Room which is provided on occupancy or at any other time during the Term, including and not limited to; furnishings, fixtures, equipment, television sets, appliances, window screens, floor coverings and any mattress covering. The Resident shall use all such items only for their intended purpose.

  • Capacity IET systems are monitored to optimize the use of resources and to control costs. Where services are hosted by external service providers (outsourced), agreements are in place to monitor capacity and performance. Availability Exclusions (Force majeure) A loss of availability from causes which are beyond the control of IET is excluded from the availability warranty. This includes but is not limited to, acts from natural events such as earthquakes, storms, natural flooding, and wild fires. Also excluded are police actions, interruptions due to protest events, labor disputes, war, pandemic, terrorism, riots, and/or inability to obtain energy. Each party must provide prompt notice of service disruptions. Services will resume as soon as possible. Either party will take all reasonable steps to remove the causes of unavailability and resume services as soon as reasonably possible. IET will provide the availability status of major services on the IET status page. Changes to services may be required by system maintenance needs, corrective actions to resolve incidents, or service improvement projects. Changes may require adherence to change management policies including formal authorizations, approvals, peer reviews, risk assessments and lead times for notifying Customers and scheduling changes. IET notifies Customers about planned technology systems are changes that may have a risk of directly or indirectly impacting IET services. Responsibilities Between Parties Information and Educational Technology Information and Educational Technology shall be responsible for ensuring that reasonable skill, care and diligence are exercised in carrying out the services properly and efficiently in accordance with this service level agreement. Data and Information Transnational data and information supplied by the Customer or its clients are owned by the Customer. IET serves as custodian of these data and will take measures to house, backup and protect the data for the Customer, consistent with the services, and as appropriate. General Customer Responsibilities Customer agrees to use and pay for the services in accordance with the terms of this agreement and in compliance with any overarching UC Xxxxx policies. Customer agrees to take appropriate steps to ensure compliance with The UC Xxxxx Cyber-safety Policy and UC Xxxxx Security Standards Policy (PPM Section 310-22). Customer agrees not to engage in actions or activities that circumvent, compromise, or introduce risks to the policy, standards or the controls established to ensure cyber security compliance. Customer is responsible for costs which result from improper use of the services and which cause damage or loss to IET or its Customers.

  • Acting Pay The qualifying period for acting pay as specified in Article 42 shall be converted to hours.

  • NO STRIKES - NO LOCKOUTS 13.01 In view of the orderly procedures established by this Agreement for the settling of disputes and the handling of grievances, the Union agrees that, during the life of this agreement, there will be no strike, picketing, slowdown or stoppage of work, either complete or partial, and the Corporation agrees that there will be no lockout.
