Common use of 2Fee Increases Clause in Contracts

2Fee Increases. After the Initial Term (as defined below), NCIT may increase Fees under Schedule B by providing written notice to Licensee at least 30 days prior to the effective date of the Fee increase, and the Fees will be deemed amended accordingly without further notice or consent; provided that NCIT will not increase Fees during the Initial Term. Notwithstanding the foregoing, during the first 5 years of this Agreement, any increase by NCIT of any Fee under Schedule B will not exceed 10 times the amount of such Fee set forth in Schedule B as of the Effective Date. Licensee may terminate this Agreement effective as of the date of the Fee increase upon providing written notice to NCIT within 30 days of receipt of the notice of Fee increase.
