4Representations of CM/GC. The Payment Application constitutes a representation by CM/GC to Owner that (i) the CM/GC has performed its Design Review Services to the point indicated and construction has progressed to the point indicated; (ii) the quality of the Work covered by the application is in accordance with the Contract Documents; (iii) CM/GC is entitled to payment in the amount requested; (iv) all Work covered by any previously approved Payment Application, for which the CM/GC has been paid, is free and clear of liens, claims, security interests or encumbrances, and (v) title to all Work covered by the Payment Application will pass to Owner no later than the time of payment.
