Above-Ground Existing Conditions. Under no circumstances shall Judicial Council be deemed to make a warranty or representation of visible or actual existing above-ground conditions, as-built conditions, which are verifiable by reasonable independent investigation by Design Build Entity. Design Build Entity shall not rely on the information supplied by Judicial Council regarding existing above-ground conditions when it submits it is a proposal or performs Design Work or Construction Work.
