ACADEMIC PUBLICATION. 5.1 Subject to clause 5.2 an employee or student of the University (whether or not involved in the Project) may, provided a Confidentiality Notice under clause 5.2 has not been given: 5.1.1 Discuss work undertaken as part of the Project in University seminars, tutorials and lectures; and 5.1.2 Publish the Results, including any Background Information, Materials & IP of the Sponsor (unless it is the Sponsor’s Confidential Information) in support of the Results. 5.2 The Sponsor and the University anticipate that a high impact academic Publication will arise following the successful conduct of the Project, and nothing in this Agreement shall prevent or hinder the University from seeking to publish such a Publication, provided that the procedure in this clause 5.2 is followed. The University will submit to the Sponsor, in writing, a copy of the proposed Publication at least [***] days before the date of the proposed submission for Publication. The Sponsor may, by giving written notice to the University (“a Confidentiality Notice”): (a) require the University to delay the proposed Publication for a maximum of [***] months after receipt of the Confidentiality Notice if, in the Sponsor’s reasonable opinion, that delay is necessary in order to seek patent or similar protect on for any of the Sponsor’s Background Information, Materials & IP or any Results that are to be Published; or (b) prevent the Publication of any of the Sponsor’s Background Information, Materials & IP that is Confidential Information. For the avoidance of doubt the University shall not publish the full stereochemical and chemical structure of any of the Sponsor’s Background Information, Materials & IP without the prior written consent of the Sponsor, provided that the Sponsor will consent to the University disclosing in a Publication sufficient information about the nature of the Sponsor’s Background Information, Materials & IP and the potential use of the same in the treatment of Muscular Dystrophy as would ordinarily be required of a high quality academic Publication. The Sponsor must give that Confidentiality Notice within [***] days after the Sponsor receives a copy of the proposed Publication. If the University does not receive a Confidentiality Notice within such [***] day period, its employee or student may proceed with the proposed Publication, provided that, whether or not a Confidentiality Notice has been given, any of the Sponsor’s Background Information, Materials & IP that is Confidential Information may not be published.

5.2 The Sponsor and the University anticipate that a high impact academic Publication will arise following the successful conduct of the Project, and nothing in this Agreement shall prevent or hinder the University from seeking wishes to publish such a Publicationany Foreground, provided that the procedure in this clause 5.2 is followed. The University will NUIG shall submit to the Sponsor, in writing, a copy of the proposed Publication to the Industry Party at least [***] days ]2 before the date of the proposed submission for Publication. Publication ("Notice Period"), and shall not make any such Publication before the said Notice Period has expired, unless it has received the prior written consent of the Industry Party to do so.
9.2 The Sponsor Industry Party may, by giving written notice to NUIG at any time during the University (“a Confidentiality Notice”):
Notice Period: (a) require that some or all of the University to delay Confidential Information of the proposed Industry Party or Background introduced by the Industry Party or Non-Severable Foreground be removed from said Publication and NUIG shall forthwith comply with any such request; and/or (b) require that the Publication be delayed for a maximum period of up to [***] months after ]2 from the date of receipt of such Publication by the Confidentiality Notice ifIndustry Party, if in the Sponsor’s reasonable opinion, that delay opinion of the Industry Party it is necessary in order needed to seek patent or similar protect on protection for any of the SponsorIndustry Party’s Background Information, Materials & IP Background; or any Results (c) recommend to NUIG that are to be Published; or
(b) prevent the Foreground described in the Publication of any of the Sponsor’s Background Information, Materials & IP that is Confidential Information. For the avoidance of doubt the University shall not publish the full stereochemical and chemical structure of any of the Sponsor’s Background Information, Materials & IP without the prior written consent of the Sponsor, provided that the Sponsor will consent to the University disclosing in a Publication sufficient information about the nature of the Sponsor’s Background Information, Materials & IP and the potential use of the same in the treatment of Muscular Dystrophy as would ordinarily should be required of a high quality academic Publication. The Sponsor must give that Confidentiality Notice within patent protected [***] days after ]2 prior to the Sponsor receives a copy of publication. In addition, NUIG shall consider in good faith all reasonable comments made by the proposed Publication. Industry Party with respect to such planned academic publication made pursuant to this Clause 9.
9.3 If the University NUIG does not receive a Confidentiality Notice within such [***] day periodany notice in accordance with this Clause 9, its employee or student it may proceed with the proposed PublicationPublication after the Notice Period.
9.4 The provisions of Clauses 8 and 9 shall not prevent any registered student of NUIG from submitting for a degree, a thesis based on any Foreground, examination of such thesis by NUIG examiners or deposit in NUIG's library, provided thatthe thesis is subject to restricted access, whether or not a Confidentiality Notice as required, and as per the provisions of Clauses 9.1-9.3. 2 ***Certain information on this page has been given, any of omitted and filed separately with the Sponsor’s Background Information, Materials & IP that is Commission. ACADEMIC PUBLICATION. 5.1 Subject For each project undertaken by the Licensor for educational and charitable purposes and to clause 5.2 an advance education through teaching and research, in addition to other rights of the Licensor under this Agreement and notwithstanding any other provision of this Agreement to the contrary, any employee or student of the University Licensor (in each case whether or not involved in the Projectparticular project) maymay do the following, provided the Licensor has not received a Confidentiality Notice from the Licensee under clause 5.2 has not been given:
5.1.1 Discuss this Section 17: discuss work undertaken as part of the Project project in University classes, seminars, tutorials tutorials, lectures and lectures; and
5.1.2 Publish the Results, including any Background Information, Materials & IP of the Sponsor (unless it is the Sponsor’s Confidential Information) in support of the Results.
5.2 The Sponsor similar academic gatherings and the University anticipate that a high impact academic Publication will arise following the successful conduct of the Projectpresentations, and nothing in this Agreement shall prevent or hinder other educational-related purposes; and publish the University activities and findings from seeking to publish such a Publication, provided that the procedure in this clause 5.2 is followedproject. The University Licensor will submit to the SponsorLicensee, in writing, a copy details of the proposed Publication any information that Licensee has marked as Licensee Confidential Information (or that should reasonably be known to be Licensee Confidential Information) that Licensor’s employee or student intends to publish or otherwise make publicly available, at least [***] sixty (60) days before the date of the proposed submission for Publicationpublication or public presentation (collectively, “Publication Notice”). The Sponsor mayUpon receipt of a Publication Notice, by giving the Licensee may give to the Licensor written notice to the University (“a Confidentiality Notice”):
(a) to require the University Licensor to delay the proposed Publication publication or presentation for a maximum of [***] six (6) months after following receipt of the Confidentiality Notice Notice, if, in the SponsorLicensee’s reasonable opinion, that delay is necessary in order to permit the Licensee to seek patent or similar protect on other protection for any of the Sponsor’s Background Information, Materials & IP or any Results that are to be Published; or
(b) prevent the Publication of Intellectual Property Rights in any of the SponsorLicensee’s Background Information, Materials & IP Confidential Information to be published or Licensor may delete the information that is considered Licensee Confidential Information. For Information from the avoidance of doubt the University shall not publish the full stereochemical and chemical structure of any of the Sponsor’s Background Information, Materials & IP without the prior written consent of the Sponsor, provided that the Sponsor will consent to the University disclosing in a Publication sufficient information about the nature of the Sponsor’s Background Information, Materials & IP and the potential use of the same in the treatment of Muscular Dystrophy as would ordinarily be required of a high quality academic Publicationpublication or other public presentation. The Sponsor Licensor must give that receive Licensee’s Confidentiality Notice within [***] thirty (30) days after the Sponsor Licensee receives a copy of the proposed PublicationPublication Notice. If the University Licensor does not receive a Confidentiality Notice within such [***] day the stated period, its employee or student may proceed with the proposed Publication, publication or other presentation may proceed. The Licensee acknowledges that the Licensor is required by its funders to demonstrate Licensor’s impact on society and agrees to provide to the Licensor any information which the Licensor reasonably requests to allow the Licensor to demonstrate that impact provided that, whether that the Licensor will not be entitled to receive or not a Confidentiality Notice has been given, disclose any of the SponsorLicensee’s Background Information, Materials & IP that is Confidential Information may not or any information which identifies or allows any living individual to be publishedidentified (unless that individual consents in writing in advance) and the information requested and disclosed under or pursuant to this clause will be general in nature.

and/or (bii) prevent excise from the Publication of any of the Sponsor’s 's Background Information, Materials & IP that is Confidential Information. For the avoidance of doubt the University shall not publish the full stereochemical and chemical structure of any of the Sponsor’s Background Information, Materials & IP without the prior written consent of the Sponsor, provided that the Sponsor will consent to the University disclosing in a Publication sufficient information about the nature of the Sponsor’s Background Information, Materials & IP and the potential use of the same in the treatment of Muscular Dystrophy as would ordinarily be required of a high quality academic Publication.
