ACCESS TO NETWORK INTERFACE DEVICE. 5.2.1 Due to the wide variety of NIDs utilized by BA (based on subscriber size and environmental considerations), AT&T may access the subscriber’s inside wire by any of the following means: 5.2.1.1 BA shall allow AT&T to connect its loops directly to BA’s multi-line residential NID enclosures that have additional space and are not used by BA or any other Telecommunications Carrier to provide service to the premise. AT&T agrees to install compatible protectors and test jacks, to maintain the protection system and equipment and to indemnify BA pursuant to Section 20.4 of this Agreement. 5.2.1.2 In all other cases, AT&T must establish the connection to BA’s NID through an adjoining NID deployed by AT&T. 5.2.1.2.1 Where an adequate length of inside wire is present and environmental conditions permit, either Party may remove the inside wire from the other Party’s NID and connect that wire to that Party’s own NID; or 5.2.1.2.2 Enter the subscriber access chamber or “side” of “dual chamber” NID enclosures for the purpose of extending a connecterized or spliced jumper wire from the inside wire through a suitable “punch-out” hole of such NID enclosures; or 5.2.1.2.3 Request BA to make other rearrangements to the inside wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting Party (i.e., AT&T, its agent, the building owner or the subscriber). Such charges will be billed to the requesting Party. 5.2.1.3 In no case shall AT&T remove or disconnect BA’s loop facilities from BA’s NIDs, enclosures, or protectors. 5.2.1.4 In no case shall AT&T remove or disconnect ground wires from BA’s NIDs, enclosures, or protectors. 5.2.1.5 In no case shall AT&T remove or disconnect NID modules, protectors, or terminals from BA’s NID enclosures. 5.2.1.6 Maintenance and control of premises wiring (inside wire) is the responsibility of the subscriber. Any conflicts between service providers for access to the subscriber inside wire must be resolved by the subscriber. 5.2.1.7 Due to the wide variety of NID enclosures and outside plant environments, BA will work with AT&T to develop specific procedures to establish the most effective means of implementing this Section 5.2.

In such cases, it shall be the responsibility of the Party disconnecting loop facilities to leave undisturbed the existing form of electrical protection (if applicable) and to maintain the physical integrity of the NID. The Party disconnecting the loop will hold BellSouth harmless for any liability associated with removal of the BellSouth loop from the BellSouth NID and the disconnecting Party will assume full liability for its actions and for any adverse consequences that may result. Furthermore, it shall be the responsibility of the disconnecting Party to reconnect the disconnected loop to a nationally-recognized-testing-laboratory-listed station protector which has been grounded as per Article 800 of the National Electrical Code within the NID. If no spare station protector exists in the NID, the disconnected loop must be appropriately cleared, capped and stored. If the disconnecting party does not wish to accept these responsibilities, other options exist in which BellSouth installs a NID as a chargeable option. 5.2.1.4 4.3.3 In no case shall AT&T either Party remove or disconnect ground wires from BAthe other Party’s NIDsNID, enclosures, or protectors. 5.2.1.5 In no case shall AT&T remove or disconnect NID modules, protectors, or terminals from BA’s NID enclosures. 5.2.1.6 Maintenance and control of premises wiring (inside wire) is the responsibility of the subscriber. AT&T Community agrees to install compatible protectors and test jacks, jacks and to maintain the protection system and equipment and to indemnify BA BellSouth pursuant to Section 20.4 8 of the General Terms and Conditions of this Agreement. 5.2.1.2 In all other cases, AT&T must establish the connection to BA’s NID through an adjoining NID deployed by AT&T. 5.2.1.2.1 2.4.3.2 Where an adequate length of the end user’s inside wire is present and environmental conditions permit, either Party may remove the inside wire from the other Party’s NID and connect that wire to that Party’s own NID; or 5.2.1.2.2 2.4.3.3 Enter the subscriber access chamber or “side” of “dual chamber” NID enclosures for the purpose of extending a connecterized or spliced jumper wire from the inside wire wiring through a suitable “punch-out” hole of such NID enclosures; or 5.2.1.2.3 2.4.3.4 Request BA BellSouth to make other rearrangements to the inside wire wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting Party (i.e., AT&TCommunity, its agent, the building owner or the subscriber). Such charges will be billed to the requesting Party. 5.2.1.3 2.4.3.5 In no case shall AT&T either Party remove or disconnect BAthe other Party’s loop facilities from BAeither Party’s NIDs, enclosures, or protectors unless: (1) the applicable Commission has expressly permitted the same; (2) the disconnecting Party provides prior notice to the other Party, and (3) the Party disconnecting appropriately caps off and guards the other Party’s loops. It will be the CLEC’s responsibility to ensure there is no safety hazard and will hold BellSouth harmless for any liability associated with the removal of the BellSouth loop from the BellSouth NID. In such cases, it shall be the responsibility of the disconnecting party, once the other Party’s loop has been disconnected from the NID, to reconnect the disconnected loop to a nationally- recognized–testing-laboratory- listed station protector, which has been grounded as per Article 800 of the National Electrical Code. If CLEC does not wish to accept this responsibility, other options exist in which BellSouth installs a NID for the CLEC as a chargeable option. 2.4.3.6 In no case shall either Party remove or disconnect ground wires from BellSouth’s NIDs, enclosures, or protectors. 5.2.1.4 2.4.3.7 In no case shall AT&T remove or disconnect ground wires from BA’s NIDs, enclosures, or protectors. 5.2.1.5 In no case shall AT&T either Party remove or disconnect NID modules, protectors, or terminals from BABellSouth’s NID enclosures. 5.2.1.6 Maintenance and control of premises wiring (inside wire) is the responsibility of the subscriber. Any conflicts between service providers for access to the subscriber inside wire must be resolved by the subscriber. 5.2.1.7 2.4.3.8 Due to the wide variety of NID enclosures and outside plant environments, BA environments BellSouth will work with AT&T Community to develop specific procedures to establish the most effective means of implementing this Section 5.2Section, 2.4.3.
