Access to Relevant Documents. Upon request and free of charge, you have the right to review, reasonable access to, and receive copies of all documents, records, and other information relied upon or otherwise relevant to your appeal. If PIC generates, relies upon, or considers any new or additional evidence in connection with an appeal, or identifies any new or additional rationale for a denial in connection with an appeal, it will be provided to you so that you have a reasonable opportunity to respond.
Access to Relevant Documents. (a) In order (1) to evaluate whether to request review of an adverse determination, and (2) if review if requested, to prepare for such review, the claimant or the claimant’s Authorized Representative will have access to all relevant documents. (b) Relevant: A document, record or other information is “relevant” if it was relied upon in making the determination, or was submitted to the Plan, considered by the Plan, or generated in the course of making the benefit determination without regard to whether it was relied upon.
