ACCIDENT MAKE-UP PAY. 23.1. The conditions under which an employee shall qualify for accident make-up payment shall be as prescribed hereunder: 23.1.1. The employer shall pay an employee accident make-up payment where the employee receives an injury for which weekly payment of compensation is payable by or on behalf of the employer pursuant to the provisions of the appropriate Workers’ Compensation Act or Ordinance as amended from time to time. 23.1.2. Accident make-up payment means a weekly payment of an amount being the difference between the weekly amount of compensation paid to the employee pursuant to the said appropriate Workers’ Compensation Act or Ordinance and the employee’s appropriate Agreement rate, or, where the incapacity is for a lesser period than one week, the difference between the amount of compensation and the said Agreement rate for that period. 23.1.3. The employer shall pay, or cause to be paid, accident make-up payment during the incapacity of the employee within the meaning of the said appropriate Act or Ordinance until such incapacity ceases or until the expiration of a period of 39 weeks from the date of injury, payment prescribed shall apply only in respect of an incapacity which results from an injury which is current during the first pay period commencing on or after or which occurs subsequent to that pay period. 23.1.4. The liability of the employer to pay make-up payment in accordance with this clause shall arise as at the date of the injury or accident in respect of which compensation is payable under the said appropriate Act or Ordinance, and the termination of the employee’s employment for any reason during the period of any incapacity shall in no way affect the liability of the employer to pay accident make-up payment as provided in this clause. 23.1.5. In the event that the employee receives a lump sum in redemption of weekly payments under the appropriate Act or Ordinance, the liability of the employer to pay accident make-up payment as herein provided shall cease from the date of such redemption.

ACCIDENT MAKE-UP PAY. 23.1. 41.1 The conditions under which an employee shall qualify for accident make-up payment shall be as prescribed hereunder: 23.1.1. The employer Employer shall pay an employee accident make-make up payment where pay if the employee receives an injury or suffers an illness for which weekly compensations of payment of compensation is are payable by or on behalf of the employer Employer pursuant to the provisions of the appropriate Workers’ Accident Compensation Act or Ordinance as amended from time to time1985 (Vic) and the Accident Compensation (Work Cover) Act 1992 (Vic). 23.1.2. 41.2 Accident make-make up payment pay means a weekly payment of an amount being the difference between the weekly amount of compensation paid to the employee pursuant to the said appropriate Workers’ Accident Compensation Act or Ordinance 1985 (Vic) and the Accident Compensation (Work Cover) Act 1992 (Vic) and the employee’s appropriate Agreement rateweekly ordinary time rate of pay, oror in the case of a part-time employee, a ordinary time rate of pay, or where the incapacity is for a lesser period of less than one week, the difference between the amount of compensation and the said Agreement pro rata ordinary time rate of pay for that the period. 23.1.3. 41.3 The employer Employer shall pay, pay or cause to be paid, paid accident make-make up payment pay during the incapacity of the employee within the meaning of the said appropriate Accident Compensation Act or Ordinance until such 1985 (Vic) and/or the Accident Compensation (Work Cover) Act 1992 (Vic) until: (a) The incapacity ceases or until the ceases; (b) The expiration of a continuous period of: (i) 39 weeks or an aggregate of 39 weeks, whichever occurs first, for Streets Employees; and (ii) 26 weeks from the date of injury, payment prescribed shall apply only in respect of an incapacity which results from an injury which is current during the first pay period commencing on or after or which occurs subsequent to that pay periodfor all other employees. 23.1.4. 41.4 The liability of the employer Employer to pay make-accident make up payment pay in accordance with this clause shall arise as at the date of the injury or accident illness in respect of which compensation is payable under the said appropriate Act or Ordinance, and the payable. 41.5 The termination of the employee’s employment for any reason during the period of any incapacity shall in no way not affect the liability of the employer Employer to pay accident make-make up payment pay as provided in this clause, save that if the termination is on account of serious and wilful misconduct of the employee, payment shall not continue beyond the date of termination. 23.1.5. 41.6 In the event that the employee receives a lump sum in redemption of weekly payments under the appropriate Act or Ordinancepayments, the liability of the employer Employer to pay accident make-make up payment as herein provided pay shall cease from the date of such redemption. 41.7 Notwithstanding the provisions of this clause: (a) The liability to pay accident make up pay to any casual, limited tenure or employees who retire (including Streets Employees), shall cease at the expiration of such engagement or 26 weeks, whichever is the lesser period; and (b) Where an employee (including a Streets Employee) had given notice of his or her intention to retire and is injured prior to the notified date of retirement, the liability to pay make up accident pay shall cease at the date on which the employee was due to retire or 26 weeks, whichever is the lesser period.
