Account Password and Security. You must register with Formally and create an account (an “Account”) to use the Services, and as part of that process you will be requested to provide certain information, including without limitation your name and email address. By using the Services, you agree to provide true, accurate, current and complete information as prompted by the registration process and otherwise in connection with your use of the Services, and to maintain and promptly update such information to keep it accurate, current and complete. You are the sole authorized user of your Account. You are responsible for maintaining the confidentiality of any log-in password, or related credentials provided by you or given to you by Formally for accessing the Services. You are solely and fully responsible for all activities that occur under your password or Account, even if not authorized by you. Formally has no control over the use of any user’s Account and expressly disclaims any liability derived therefrom. Should you suspect that any unauthorized party may be using your password or Account or you suspect any other breach of security, you agree to contact Formally immediately. The person signing up for the Services will be the contracting party (“Account Owner”) for the purposes of these Terms of Service and will be the person who is authorized to use any corresponding Account we provide to the Account Owner in connection with the Services; provided, however, that if you are signing up for the Services on behalf of your employer or your organization, your employer or organization shall be the Account Owner. As the Account Owner, (i) you are solely responsible for complying with these Terms of Service and only you are entitled to all benefits accruing thereto, and (ii) to the extent you grant access to the Services under your Account to others, such as your employees, affiliates or service providers, Visa Applicants or attorneys (each, an “Authorized User”), then you are responsible for the compliance of such Authorized Users with this Agreement. Your Account is not transferable to any other person or account. If you are an Authorized User, you acknowledge and agree that the Account Owner may provision or deprovision your access to the Services and manage permissions and data retention and export policies. These controls may affect your access and use of the Services and the disclosure, modification or deletion of information you provide to the Services.

You are solely and fully responsible for all activities that occur under your password or Account, even if not authorized by you. You hereby authorize Pay Tgthr, directly or through third parties, to make any inquiries we consider necessary to validate your identity and/or authenticate your identity and Account information. This may include asking you for further information and/or documentation about your identity, or requiring you to take steps to confirm ownership of your email address, wireless/cellular telephone number or financial instruments, and verifying your information against third party databases or through other sources. You may not create more than one (1) Account. Each unique mobile device may not be associated with more than one (1) user Account. Users who attempt to associate an excessive number of mobile devices with a single user Account may be deemed to have violated this Agreement to the extent they are an Authorized User, you acknowledge and agree that the Account Owner may provision or deprovision your access deemed by Pay Tgthr to have abused the Services and manage permissions and data retention and export policiesmay be subject to Account suspension or closure. These controls may affect We reserve the right to modify or discontinue access to your access and use Account or certain interactive features of the Services Site at any time and the disclosurefor any reason, modification or deletion of information without prior notice to you provide to the Servicesunless required by law.
