Common use of Acquisition Cost Clause in Contracts

Acquisition Cost. “Acquisition Cost” shall mean the actual invoiced price paid by either Party to any Third Party, including without limitation shipping and handling costs and customs duties, in connection with the acquisition of Active Pharmaceutical Ingredients, Excipients, packaging or other materials utilized in the production of Product hereunder.

Acquisition Cost. “Acquisition Cost” shall mean the actual invoiced price paid by either Party to any Third PartyParty for acquiring Active Pharmaceutical Ingredients, including without limitation Excipients or packaging materials hereunder, including, but not limited to, shipping and handling costs and customs duties, duties incurred and paid by such Party to any Third Party in connection with the acquisition of Active Pharmaceutical Ingredients, ExcipientsExcipients or packaging materials, packaging or other materials utilized in as the production of Product hereundercase may be.

Acquisition Cost. “Acquisition Cost” shall mean the actual invoiced price paid by either Party to any Third Party (adjusted for any discounts, rebates or refunds realized by the payor Party), including without limitation shipping and handling costs costs, taxes and customs dutiesduties to the extent invoiced, in connection with the acquisition of Active Pharmaceutical Ingredients, Excipients, packaging or other materials utilized in the production of Product hereunderManufacturing.
