Common use of ACTIVE AND WAITLIST CONTRACTORS; CONTRACTOR PERFORMANCE Clause in Contracts

ACTIVE AND WAITLIST CONTRACTORS; CONTRACTOR PERFORMANCE. EVALUATION PROCESS OGS will maintain twenty (20) Active Contractors and up to five (5) Waitlisted Contractors at any given point during the HBITS Contract. Contractors will be evaluated on their performance as stated in Section 6.4 and Appendix F of this Contract on an annual basis. The Contractor Performance Evaluation Form and process can be found in Appendix F. As a result of this evaluation, the five (5) Active Contractors with the lowest performance scores will be moved to the Waitlist at the end of each Contract year and the five (5) Waitlisted Contractors will be moved to Active status. This performance cycle will repeat at the end of each 12 month period; a Contractor will not be on the Waitlist for more than one (1) year at a time. In the event of a tie amongst the five (5) Active Contractors with the lowest performance scores, the MSP will compare each Contractor’s rates in Appendix D by calculating a weighted average Hourly Xxxx Rate based on that evaluation period. The Contractor with the lower weighted average Hourly Xxxx Rate will retain its position on the Active list. The Hourly Xxxx Rates for each such Engagement shall be totaled to determine the sum of Final Cost for All Engagements. The Contractor(s) with the lowest sum of Final Cost for all Engagements will retain its position on the Active list.
