Common use of Actual Performance of Duties Clause in Contracts

Actual Performance of Duties. Injury leave with pay shall be granted to an employee only for original or recurrent injuries determined by the Director of Human Resources or designee as caused by the performance of the actual duties of his/her position. Whenever an employee is required to stop working because of an injury or other service connected disability, he/she shall be paid for the remaining hours of that day or shift at his/her regular rate, and such time shall not be charged to leave of any kind. The City may require an independent medical examination for any employee requesting injury leave, at the City's expense.
