Adjudication by the Commission. 23.4.1 In the event a Dispute is required under Applicable Laws to be adjudicated upon by the Commission, such Dispute shall, instead of reference to arbitration under Clause 23.3, be submitted for adjudication by the Commission in accordance with Applicable Laws and all references to Dispute Resolution Procedure shall be construed accordingly. For the avoidance of doubt, the Parties hereto agree that the adjudication hereunder shall not be final and binding until an appeal, if any, against such adjudication has been decided by the appellate tribunal, or no such appeal has been preferred within the time specified in the Applicable Law.

Adjudication by the Commission. 9.3.1 In the event any dispute falls under the purview of any Statutory Regulatory Commission, such dispute shall, instead of reference to arbitration under Article 9.4, be adjudicated upon by such Regulatory Authority or Commission in accordance with the Applicable Law and all references to Dispute Resolution Procedure shall be construed accordingly. 9.3.2 For the avoidance of doubt, the Parties hereto agree that the adjudication hereunder shall not be-final and binding until an appeal against such adjudication has been decided by an appellate tribunal or High Court, as the case may be, or no such appeal has been preferred within the time specified in the Applicable Law. 9.3.3 Where any dispute is referred by the Regulatory Authority or Commission to be settled through arbitration, the procedure specified in Article 9.4 shall be followed to the extent applicable.
