Adjustment for Compensation Paid by NS. The Losses payable to Transmission Customer as a result of the occurrence of a Government Action shall be net of any compensation paid to Transmission Customer by NS as part of the Government Action or as a result of the Government Action. There is no obligation on the Transmission Customer to exercise its rights against NS under the Inter-Provincial Agreement, or otherwise, prior to exercising its rights under this Agreement, or at all, in order to exercise its rights against the Transmission Provider under this Agreement.
