Common use of Administrative Appeals of Disciplinary Decisions Clause in Contracts

Administrative Appeals of Disciplinary Decisions. ‌ Any appeal of a dismissal, demotion, suspension, reduction in salary, written reprimand, or transfer for purposes of punishment shall be heard by a Hearing Officer selected pursuant to the procedures set forth in the Article titled “Hearing Officer” of this Memorandum of Understanding. The decision of the Hearing Officer in an administrative appeal of a punitive action shall be binding on all parties. Administrative appeal hearings conducted pursuant to this Article shall be conducted in accordance with the procedures set forth in Rule XI (“Disciplinary Actions”) of the Personnel Rules for Board-Governed Special Districts (except that the selection and appointment of the Hearing Officer shall be made pursuant to the provisions of this Memorandum of Understanding rather than Section 7 of Personnel Rule XI).
