Common use of Administrative Late Charge Clause in Contracts

Administrative Late Charge. Notwithstanding any other remedies for nonpayment of rent, if the monthly payment of Basic Rent and Additional Rent are not received by Landlord on or before the fifth (5th) day after written notice of non-payment of the month for which such rental is due, or if any other payment due Landlord by Tenant is not received by Landlord on or before the tenth (10) day of the month next following the month in which Tenant was invoiced, an administrative late charge of five percent (5%) of such past due amount shall become due and payable, as Additional Rent, in addition to such amounts owed under this Lease to help defray the additional cost to Landlord for processing such late payments.

Notwithstanding any other remedies for nonpayment of rent, if the monthly payment of Basic Rent and Additional Rent are not received by Landlord on or before the fifth seventh (5th7th) day after written notice of non-payment of the month for which such rental is due, or if any other payment due Landlord by Tenant is not received by Landlord on or before the tenth seventh (107th) day of the month next following the month in which Tenant was invoiced, an administrative late charge of five four percent (54%) of such past due amount shall become due and payable, as Additional Rent, in addition to such amounts owed under this Lease to help defray the additional cost to Landlord for processing such late payments. Notwithstanding the foregoing, Tenant shall not be required to pay a late charge with respect to the first delinquent payment made by Tenant during any Year.
