Adoption of Terms and Conditions. The Parties agree to incorporate the 2010 CFA by reference as if fully stated herein so as to apply those terms and conditions to the actions of the Parties for WMATA’s Fiscal Year 2020, from the Effective Date of this 2020 CFA through June 30, 2020.
Adoption of Terms and Conditions. (a) The Parties agree that the terms and conditions of the Reference Agreement, with the modifications set forth in this Agreement (including without limitation Schedule B attached hereto), shall govern any and all Transactions between the Parties during the Interim Period and agree to be bound by such terms and conditions, as so modified, as if such terms and conditions were set forth in full herein. The Reference Agreement, as so modified, shall hereinafter be referred to herein as the “Restated Master Agreement”, and references to “this Agreement” shall include the terms and conditions of the Restated Master Agreement incorporated herein. Without limiting the generality of the first sentence of this paragraph, each Party agrees to be bound by all covenants, agreements and other obligations applicable to it under the Restated Master Agreement during the Interim Period. Each of the representations or warranties made by either Party in the Restated Master Agreement is made as of the date hereof for the benefit of the other Party as if such representation or warranty was set forth in full herein.
