Common use of Aggregated Statistics Clause in Contracts

Aggregated Statistics. Notwithstanding anything to the contrary in this XXXX, Provider may monitor your use of the PRODUCTS AND SERVICES and collect and compile data and information related to your use of the PRODUCTS AND SERVICES to be used by Provider in an aggregated and anonymized manner, including to compile statistical and performance information related to the provision and operation of the PRODUCTS AND SERVICES (”Aggregated Statistics”). As between Provider and you, all right, title, and interest in Aggregated Statistics, and all intellectual property rights therein, belong to and are retained solely by Provider. You acknowledge that Provider may compile Aggregated Statistics based on information, data, and other content, in any form or medium, you input, submit or transmit through the PRODUCTS AND SERVICES .You agree that Provider may (i) make Aggregated Statistics publicly available in compliance with applicable law, and (ii) use Aggregated Statistics to the extent and in the manner permitted under applicable law; provided that such Aggregated Statistics does not comprise any of your confidential information.

As between Provider and youCustomer (and its Authorized Users), all right, title, and interest in Aggregated Statistics, and all intellectual property rights therein, belong to and are retained solely by Provider. You Customer and its Authorized Users acknowledge that Provider may compile Aggregated Statistics based on information, data, Customer Data input into the Cloud Services. Customer and other content, in any form or medium, you input, submit or transmit through the PRODUCTS AND SERVICES .You its Authorized Users agree that Provider may (i) make Aggregated Statistics publicly available in compliance with applicable law, and (ii) use Aggregated Statistics to the extent and in the manner permitted under applicable law; provided that such Aggregated Statistics does do not comprise any of your confidential informationidentify Customer (or the applicable Authorized User) or Customer’s (or its Authorized User’s) Confidential Information.
