Agreement Amended. Subject to the provisions of this Section 4, this Amendment shall be deemed to be an amendment to the Employment Agreement. All references to the Employment Agreement in any other document, instrument, agreement or writing hereafter shall be deemed to refer to the Employment Agreement as amended hereby.
Agreement Amended. Subject to the provisions of this Section 7, this Amendment shall be deemed to be an amendment to the Sublicense Agreement. All references to the Sublicense Agreement in any other document, instrument, agreement or writing hereafter shall be deemed to refer to the Sublicense Agreement as amended hereby.
Agreement Amended. Subject to the provisions of this Section 7, this Amendment shall be deemed to be an amendment to the Agreement. All references to the Agreement in any other document, instrument agreement or writing hereafter shall be deemed to refer to the Agreement as amended hereby.
Agreement Amended. Subject to the provision of this Section 3, this Amendment shall be deemed to be an amendment to the Placement Agency Agreement. All references to the Placement Agency Agreement in any other document, instrument agreement or writing hereafter shall be deemed to refer to the Placement Agency Agreement as amended hereby.
Agreement Amended. Subject to the provisions of this Section 8, this Amendment shall be deemed to be an amendment to the Agreement. All references to the Agreement in any other document, instrument agreement or writing hereafter shall be deemed to refer to the Agreement as amended hereby.
Agreement Amended. The Agreement is hereby amended to the extent necessary to effectuate the purposes set forth in this Amendment.
Agreement Amended. Subject to the provisions of this Section 3, this Amendment and Joinder shall be deemed to be an amendment to the Registration Rights Agreement. All references to the Registration Rights Agreement in any other document, instrument, agreement or writing hereafter shall be deemed to refer to the Registration Rights Agreement as amended hereby.
Agreement Amended. Subject to the provisions of this Section 3, this Amendment shall be deemed to be an amendment to the Notes. All references to the Notes in any other document, instrument, agreement or writing hereafter shall be deemed to refer to the Notes as amended hereby. In the event of a conflict between the terms of the Notes and this Amendment, the terms of this Amendment shall control.
Agreement Amended. Subject to the provisions of this Section 6, this Amendment shall be deemed to be an amendment to the License Agreement and the Subscription Agreement. All references to the License Agreement or the Subscription Agreement in any other document, instrument, agreement or writing hereafter shall be deemed to refer to the License Agreement or the Subscription Agreement, as the case may be, as amended hereby. However, except as expressly provided herein, the License Agreement and the Subscription Agreement shall remain in full force and effect without amendment or modification. This Amendment contains the entire agreement and understanding of the parties regarding the subject matter of this Amendment.
Agreement Amended. Subject to the provisions of this Section 4, this Amendment shall be deemed to be an amendment to the 2007 Securities Purchase Agreement and the Notes. All references to the 2007 Securities Purchase Agreement or the Notes in any other document, instrument, agreement or writing hereafter shall be deemed to refer to the 2007 Securities Purchase Agreement and Notes as amended hereby.
