Agreement on Plan of Bankruptcy. The parties agree that at the Company's sole discretion, this Agreement may be declared by the Company to be null and void if: (1) Bentxx xxx the Company have not agreed upon and filed a proposed joint plan of reorganization and disclosure statement in Bentxx'x Xxxpter 11 bankruptcy case by February 15, 2000; and/or (2) at any time prior to the entry of a final, nonappealable order confirming a plan of reorganization for Bentxx xx his Chapter 11 bankruptcy case that the Company either voted in favor of or proposed, Bentxx xxxs not support the Company's position.
