Aircraft Gates. In the event the ATMP EIR is certified, the ATMP is approved and both Concourse 0 and Terminal 9 are operational, LAWA will implement its plan to complete decommissioning 15 of the 18 West Remote Gates (as described in the ATMP EIR) and LAWA will commit that the Midfield Satellite Concourse (MSC) will operate no more than 25 gates (a reduction of 4 gates from the maximum of 29 gates approved in the MSC Program EIR) through 2030, unless extended pursuant to paragraph I.D. above, but in no case later than December 31, 2032. LAWA will provide escort/transportation to enable El Segundo to count the gates in operation at Concourse 0, Terminal 9, the West Remote gates, and gates at the MSC annually. LAWA will produce an annual "snapshot" report/map showing current location, size and configuration of all passenger gates (contact and remote) at LAX.

Aircraft Gates. Aircraft gates at MIA shall be striped for the largest aircraft down to the smallest commercial aircraft that can be accommodated at that gate, using minimum accepted aircraft clearances. MDAD shall use 20’ for wingtip, 15’ for engine nacelles, and 8’ for wingtip leading edge and fuselage, as accepted clearances.

In the event that any non-standard maintenance is required during the term and will interfere with User’s requested or scheduled flights, Operator, or Operator’s pilot-in-command, shall notify User of the maintenance required, the effect on the ability to comply with User’s requested or scheduled flights and the manner in which the parties will proceed with the performance of such maintenance and conduct of such flight(s). In no event shall Operator be liable to User or any other person for loss, injury or damage occasioned by the delay or failure to furnish the Aircraft under this Agreement, whether or not maintenance-related.
