Common use of Alcohol Driving Offenses Clause in Contracts

Alcohol Driving Offenses. A sensitive employee convicted of an off-duty alcohol driving offense, and a non- sensitive employee convicted of any alcohol driving offense shall: A. on the first conviction, be referred to an Employee Assistance Program and, in addition, be subject to appropriate discipline; B. on the second conviction, be suspended for a minimum of five (5) days, be referred to an Employee Assistance Program, be required to participate successfully in the designated treatment program, and be subject to any appropriate disciplinary action, up to and including termination; C. on the third conviction, be terminated.
