Common use of Alcoholism or Other Drug Abuse Clause in Contracts

Alcoholism or Other Drug Abuse. OP17-1 The University agrees that it may test or refer for testing and/or treatment a bargaining unit member for alcohol or other drug abuse if an accident has occurred that causes damage to property or persons, or there exists a reasonable suspicion that an employee’s work performance is impaired due to alcohol or other drug use. The University expressly agrees not to perform or require any other alcohol or drug testing during the life of this Agreement including, but not limited to, random testing, testing prior to promotion, or periodic testing except as required by law.
