Common use of ALTERNATIVE MANNER OF PROCEDURE Clause in Contracts

ALTERNATIVE MANNER OF PROCEDURE. If, after receipt by the Administrative Agent and each of the Banks of a Competitive Bid Quote Request from the Borrower in accordance with Section 4.3, the Administrative Agent or any Bank shall be unable to complete any procedure of the auction process described in Sections 4.5 through 4.6 (inclusive) due to the inability of such Person to transmit or receive communications through the means specified therein, such Person may rely on telephonic notice for the transmission or receipt of such communications. In any case where such Person shall rely on telephone transmission or receipt, any communication made by telephone shall, as soon as possible thereafter, be followed by written confirmation thereof.

ALTERNATIVE MANNER OF PROCEDURE. If, after receipt by the Administrative Agent and each of the Banks of a Competitive Bid Quote Request from the Borrower in accordance with Section §4.3, the Administrative Agent or any Bank shall be unable to complete any procedure of the auction process described in Sections §§4.5 through 4.6 (inclusive) due to the inability of such Person to transmit or receive communications through the means specified therein, such Person may rely on telephonic notice for the transmission or receipt of such communications. In any case where such Person shall rely on telephone transmission or receipt, any communication made by telephone shall, as soon as possible thereafter, be followed by written confirmation thereof.

If, after receipt by the Administrative Agent and each of the Banks Lenders of a Competitive Bid Quote Request from the Borrower in accordance with Section 4.32A.3, the Administrative Agent or any Bank Lender shall be unable to complete any procedure of the auction process described in Sections 4.5 2A.5 through 4.6 2A.6 (inclusive) due to the inability of such Person to transmit or receive communications through the means specified therein, such Person may rely on telephonic notice for the transmission or receipt of such communications. In any case where such Person shall rely on telephone transmission or receipt, any communication made by telephone shall, as soon as possible thereafter, be followed by written confirmation thereof.

In any case where such Person shall rely on telephone transmission or receipt, any communication made by telephone shall, as soon as possible thereafter, be followed by written confirmation thereof.

If, after receipt by the Administrative Agent and each of the Banks Lenders of a Competitive Bid Quote Request from the Borrower in accordance with Section 4.32A.3, the Administrative Agent or any Bank Lender shall be unable to complete any procedure of the auction process described in Sections 4.5 Section s2A.5 through 4.6 2A.6 (inclusive) due to the inability of such Person to transmit or receive communications through the means specified therein, such Person may rely on telephonic notice for the transmission or receipt of such communications. In any case where such Person shall rely on telephone transmission or receipt, any communication made by telephone shall, as soon as possible thereafter, be followed by written confirmation thereof.

If, after receipt by the Administrative Agent and each of the Banks Lenders of a Competitive Bid Quote Request from the Borrower Borrowers' Representative in accordance with Section 4.3, 2.6(c) the Administrative Agent or any Bank Lender shall be unable to complete any procedure of the auction process described in Sections 4.5 through 4.6 2.6(e) and (f) (inclusive) due to the inability of such Person to transmit or receive communications through the means specified therein, such Person may rely on telephonic notice for the transmission or receipt of such communications. In any case where such Person shall rely relay on telephone transmission or receipt, any communication made by telephone shall, as soon as possible thereafter, be followed by written confirmation thereof.

ALTERNATIVE MANNER OF PROCEDURE. If, after receipt by the Administrative Agent and each of the Domestic Banks of a Competitive Bid Quote Request from the Borrower Company in accordance with Section 4.35.3, the Administrative Agent or any Domestic Bank shall be unable to complete any procedure of the auction process described in Sections 4.5 Sub Section 5.5 through 4.6 5.6 (inclusive) due to the inability of such Person to transmit or receive communications through the means specified therein, such Person may rely on telephonic notice for the transmission or receipt of such communications. In any case where such Person shall rely on telephone transmission or receipt, any communication made by telephone shall, as soon as possible thereafter, be followed by written confirmation thereof.
