Ancillary Staff Layoff. In some instances, it may be economically necessary to reduce the Ancillary Staff positions as follows: In order to promote an orderly reduction in Ancillary Staff when the educational program and curriculum are reduced, the following procedure will be used: a. The Association will be involved when any layoffs need to occur. The Association and Board will work together in order to ensure that the identified procedure is followed. b. In the event tenure Ancillary Staff must be laid off, lay off will be on the basis of seniority, provided the more senior is certified and qualified for the remaining assignments. It is expressly understood that the Association shall have a right to review the layoff list prior to notification of the individuals to be laid off. In the event of a dispute concerning the layoff list, the Association may, within five (5) days, request a review with the Superintendent. If the dispute is not resolved, the Association shall have the right to file a grievance. c. In the event any Ancillary Staff is given notice of lay off from his/her position, any placement into a teaching position shall be in accordance with Article IX (D). d. Notification will be given as soon as reasonably possible but not less than 30 calendar days' notice shall be given to Ancillary Staff who are to be laid off. Such notice shall be in writing with a copy to the Association.
