Common use of Annual Minimum Clause in Contracts

Annual Minimum. In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & 6, Xxxxx agrees to use a minimum of dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible or Transportation gas provided hereunder. The contract year will be the period beginning on October 1 of each calendar year and cominuing through September of the following year. Deficit volumes in any contract year will be billed at eighty-six cents ($0.86) per dekatherm.

Annual Minimum. In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & 6Category 2, Xxxxx agrees to use a minimum of 9,217 dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible or Transportation Firm gas provided hereunder. The contract year will be the period beginning on October 1 1, or as soon thereafter as Buyer and Seller have their respective facilities installed, and continuing for a term of each one full calendar year and cominuing through September of the following year. Deficit volumes in any contract year will be billed at eightyone dollar and thirty-six five cents ($0.86) per dekatherm1.

In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & 6Category 2, Xxxxx Buyer agrees to use a minimum of 23,487 dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible Firm or Transportation gas provided hereunder. The contract year will be the period beginning on October November 1 of each calendar year and cominuing continuing through September November 30 of the following year. Deficit volumes in any contract year will be billed at eighty-six cents One dollar ($0.861.00) per dekatherm.

In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & 6Category 2, Xxxxx agrees to use a minimum of 10,113 dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible or Transportation gas provided hereunder. The contract year will be the period beginning on October May 1 of each calendar year and cominuing continuing through September April 31 of the following year. Deficit volumes in any contract year will be billed at eighty-six cents ($0.86) 1.2034 per dekatherm.

In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & 6Category 3A, Xxxxx Buyer agrees to use a minimum of 8,350 dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible or Transportation gas provided hereunder. The contract year will be the period beginning on October January 1 of each calendar year and cominuing continuing through September December 31 of the following year. Deficit volumes in any contract year will be billed at eightyone dollar and forty-six cents ($0.861.46) per dekatherm.

Annual Minimum. In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & 6Category 3F, Xxxxx agrees to use a minimum of 19,561 dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible or Transportation gas provided hereunder. The contract year will be the period beginning on October March 1 of each calendar year and cominuing continuing through September February 28 of the following year. Deficit volumes in any contract year will be billed at eightyninety-six cents ($0.860.96) per dekatherm.

Annual Minimum. In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & Category 6, Xxxxx Buyer agrees to use a minimum of 60,000 dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible or Transportation gas provided hereunder. The contract year will be the period beginning on October January 1 of each calendar year and cominuing continuing through September December 1 of the following year. Deficit volumes in any contract year will be billed at eightyninety-six cents ($0.860.96) per dekatherm.

This minimum quantity may be satisfied by the use of Firm, Interruptible or Transportation gas provided hereunder. The contract year will be the period beginning on October June 1 and continuing for a term of each one full calendar year and cominuing through September of the following year. Deficit volumes in any contract year will be billed at eighty-six eighty• eight cents ($0.860.88) per dekatherm.

Annual Minimum. In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & Category 6, Xxxxx agrees to use a minimum of 7,860 dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible or Transportation gas provided hereunder. The contract year will be the period beginning on October April 1 of each calendar year and cominuing continuing through September March 31 of the following year. Deficit volumes in any contract year will be billed at eightyforty-six eight cents ($0.860.48) per dekatherm.

Annual Minimum. In consideration of Seller's investment in the facilities required to provide Buyer's requirements in Priority-of-Service Categories 3A & 6Category 3A, Xxxxx agrees to use a minimum of 10,048 dekatherms of natural gas per contract year. This minimum quantity may be satisfied by the use of Interruptible System Supply or Transportation gas provided hereunder. The contract year will be the period beginning on October December 1 of each calendar year and cominuing continuing through September November 30 'of the following year. Deficit volumes in any contract year will be billed at eightyone dollar and fifty-six two cents ($0.861.52) per dekatherm.
